This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued. This solicitation is issued as an RFQ. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2022-05 published in the Federal register March 7, 2022. This solicitation is set-aside for Small Business Brand Name Only The associated North American Industrial Classification System (NAICS) code for this procurement is 339112 (Surgical and Medical Instrument Manufacturing), with a small business size standard of 1000 Employees. The FSC/PSC is 6515 (Medical and Surgical Instruments, Equipment and Supplies) The Network Contracting Office (NCO) 6 Regional Procurement Office (RPO) EAST Hampton VA Medical Center, 100 Emancipation Drive, Hampton VA 23667 is seeking to purchase ScriptPro Eyecon Model 9430. This procurement is for new OEM medical equipment only for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the government. All quoters shall submit responses no later than 10:00 am Eastern Standard Time (EST) Wednesday April 13, 2022. No telephone inquiries will be accepted. Award will be based upon a comparative evaluation of quotes in accordance with the Simplified Acquisition Procedures of FAR 13. Comparative evaluation is the side by side pairwise comparison of quotes based on factors resulting in a Contracting Officer decision for the quote most favorable to the Government. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. The award will be made to the response most advantageous to the Government. Responses should contain your best terms, conditions. Morris Ruth.morris@va.gov DEPARTMENT OF VETERANS AFFAIRS Justification for Brand Name IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C246-22-AP-3091 Contracting Activity: Department of Veterans Affairs, VISN 06, Hampton VA Medical Center, 100 Emancipation Drive Hampton VA 23667 Purchase Request Number: 590-22-2-985-0313 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Script Pro EYECON Model 9430 uses advanced machine vision technology to accurately count tablets and capsules (pills). Each drug has an associated Drug Number, drug name and shadow pill used for counting. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Hampton VAMC have a requirement to procure brand-name Script Pro Eyecon Model 9430 for the Pharmacy Department. The ScriptPro Eyecon Model 9430 is a replacement/upgrade of the existing Eyecon unit currently being used in the Pharmacy. With this replacement ScriptPro offers a trade-in allowance. This unit is connected to the current Scriptpro Machine and is the only one that can interface with it. The Eyecon Model 9430 will allow Hampton VA to scan controlled substance for accuracy, count and documentation. The ScriptPro manufacturer equipment is the only equipment can be utilized with the ScriptPro Eyecon Model 9430. If another vendors equipment is installed the current warranty will be voided and could limit or disable functionality of the system. This procurement is in direct support of the Pharmacy department continuity of dispensing of medication. Based on facility need and existing conditions, like or similar items will not suffice. Description of market research conducted and results or statement why it was not conducted: Market research was conducted by querying the VIP search conducted on 03/30/2022 utilizing NAICS 339112 and Key Words EYECON Model 9430 revealed 07 vendors: 07 SDVOSB and no VOSB. NAC searched using keyword 36F79719D0135 and Eyecon Model 9430 revealed 3 possible with one possible match - item details: YY625438 SIN: A92-Medicatin and Supply Packaging and Dispensing Equipment used for informational purposes. SAC searched using keyword EYECON MODEL 9430 revealed no results. GSA eLibrary search using keyword 36F79719D0135 revealed item available under 65IIA under Medical Equipment and Supplies from contractor Scriptpro USA, Inc. expires 6/30/2024, 34 Contractors: 9 SDVOSB and 11 VOSB. GSA Advantage: searched using keyword EYECON MODEL 9430 under contract 36F79719D0135 revealed 3 results, no exact match. FPDS searched using keyword EYECON Model 9430 under department of veteran affairs revealed 08 purchase orders; that were used for information purposes only. SBA Dynamic Small Business Search (SBDS) search using NAICS 339112, and keywords EYECON MODEL 9430 revealed no potential vendors. SBA.gov was used to verify 339112 size standards as 1000 Employees. NCO 04 previously purchased several Script Pro Eyecon Model 9430 under award 36C24421P0802 on 09/10/2021 to SCRIPTPRO USA, INC (Small Business: DUN 024482296); 1 offer received. The Brand Name Market Research specific items are available from the (OEM) ScriptPro USA, Inc. (Small Business (DUN: 024482296). The ScriptPro Equipment is proprietary and may only be purchased through ScriptPro or from its authorized distributor Veterans Healthcare Supply Solutions: SDVOSB (DUNS: 962335357). The VA Rule of Two will not be met for this requirement. Market research has indicated that fair reasonable pricing can be obtained. The Contracting Officer does have a reasonable expectation of receiving 2 or more quotes from SB if we were to set this requirement aside as 100% Small Business. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
