- Description
- The United States Department of Commerce (DOC), National Institute of Standards and Technology (NIST), Acquisition Management Division (AMD) intends to negotiate, on a sole source basis, with Hopewell Design Inc.; 5940 Gateway Drive, Alpharetta, GA 30004-6413 for the purchase of a Hopewell GR420 Irradiator to be utilized by NIST�s Physical Measurements Laboratory (PML). The statutory authority for this acquisition is FAR 13.106-1(b). ***** Sole source determination is based on the need to acquire one (1) control and data acquisition system for 4 irradiator units that are used as part of the NIST dosimetry group air kerma calibration service program. ��The current system is a NIST custom-built control and data acquisition system which is integrated with 4 irradiator units and was built in several phases more than 30 years ago. A latest upgrade of this system done more than 15 years ago was made by Hopewell Designs and integrates with one of the four (4) existing irradiators. The current system being replaced was installed in the past by Hopewell Designs and it is currently hardwired and fully integrated with the existing system in the horizontal beam facility.� This existing Hopewell control unit plus the wiring of this unit into the existing laboratory is proprietary to Hopewell and therefore only Hopewell is able to modify and replace this existing system by the new one. In addition to the proprietary aspects of this procurement mentioned above, there is also a security issue that justifies a sole source with Hopewell. The irradiators that forms part of the facility are regulated by the U.S. Nuclear Regulatory Commission (NRC). As such, NIST as a NRC licensee must comply with all safety and security requirements. One of these requirements is regarding the use of information associated with the radioactive source devices in this facility.� The information is considered sensitive and must be treated as such.� The reason for this is to prevent the theft of these sources and its use for malicious purposes.� The implications of the Code of Federal Regulation Part 37 on this procurement are that because of security reasons, the design specifications contained in this statement of work in addition to additional information that needs to be supplied such as room diagrams and pictures where the sources are currently located, shall not be made available to the public in the interest of national security.� Hopewell Designs Inc (HDI) has done previous work in this facility and has the necessary knowledge of the existing facility to replace the existing equipment so that the new control and data acquisition system can be integrated appropriately without compromising security information. Limiting the disclosure of the information contained in this procurement to this single vendor will prevent NIST to have to disclose publicly sensitive information which could have security implications. Hopewell Design Inc.is the sole manufacturer and distributor of the equipment that meets the required minimum specifications. ***** The North American Industry Classification System (NAICS) code applicable for this acquisition is 334517 � Irradiation Apparatus Manufacturing, with a small business size standard of 1,000 employees. *****A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government.� Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.� *****No solicitation package will be issued.� This notice of intent is not a request for quotations; however, all responsible sources interested may identify their interest and capability to respond to this requirement. Interested parties that believe they can satisfy the requirements listed above must identify their capability in writing before the response date of this notice.
