- E.4 52.212-2 EVALUATION COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021) (a) The Government will award a Firm Fixed Price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical: the extent to which the offer can meet and/or exceed the Government s requirements as outlined in the solicitation and based on the information requested in the instructions to offerors section of the solicitation. Submit product literature and/or other documentation which clearly evidences the capability of the product offered to meet or exceed the need of the Government as outlined in the statement of need, any attachments, and elsewhere in this solicitation. Offerors shall also include a signed copy of VAAR 852.219-78 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING CERTIFICATE OF COMPLIANCE FOR SUPPLIES AND PRODUCTS (SEP 2021) (DEVIATION) Offerors shall also submit a letter of authorization from each Original Equipment Manufacturer. Delivery: ability to meet or exceed the Governments delivery requirement(s) outlined in the statement of need, any attachments, or elsewhere in this solicitation. Past Performance: offerors submit at least 3 examples that are recent within the past 2 years and relevant (similar products or services). Price: The Government will evaluate the price by adding the total of all line item prices. The Total Evaluated Price will be that sum. (b) Evaluation Approach. The Government will evaluate quotations using the comparative evaluation process outlined in FAR 13.106-2 (b)(3), where quotations will be compared to one another to determine which provides the best benefit to the Government. Once one quotation/offer is found acceptable, it is compared to the remaining technically acceptable quotes/offers, and the best one is chosen for the best value to the government. The Government reserves the right to consider a quotation other than the lowest price that provides additional benefit(s). Quotations may exceed minimum requirements of the solicitation. The Government reserves the right to select a quotation that provides benefit to the Government that exceeds the minimum requirements of the solicitation, but is not required to do so. Each response must meet the minimum requirements of the solicitation. The Government is requesting or accepting alternate quotations. The Government intends to make award selection without clarification or discussion but may determine after evaluating submitted quotes that the elements stated in FAR 13.106-2(b) for evaluation procedures are necessary and conduct them as appropriate. The Government reserves the right to make no award if no quotes meet the requirements of this solicitation. To be eligible for award offerors must be registered in System for Award Management (SAM) prior to submission of quote in accordance with the provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items. SDVOSB s must be certified and verified in VetBiz prior to submission. Note: Quotes received not conforming to the SON, RFQ, and evaluation criteria will not be evaluated or considered for award.
