- NOTICE OF INTENT TO ISSUE AN ORDER.� This is not a request for competitive proposals/quotes. The Centers for Disease Control and Prevention (CDC) hereby announces its intent to issue a sole source order to ScImage, 4916 El Camino Real, Los Altos, CA 94022 for PICOM Software Maintenance Agreement. The NAICS code for this acquisition is 511210 Software Publishers, with a size standard of $41.5 million. SECTION 1 � BACKGROUND NIOSH approved radiograph facilities (hospitals, clinics, and mobile health units) send digital radiographs to NIOSH as part of the Coal Workers� Health Surveillance Program (CWHSP). The CWHSP was created to improve the health of our nation�s coal miners and occupational health research. PICOM Enterprise and PICOM Cloud were purchased and implemented in 2009 to enable NIOSH to receive, manage, classify, and store digital radiographs. The original contracts (200-2009-32569 and 254-2010-35292) were awarded to ScImage in Los Altos, CA. SECTION 2 � PURPOSE A software support agreement is required to install updates for PICOM Enterprise and PICOM Cloud to keep the software current, operating efficiently, and remediate vulnerabilities. Technical support is also required to troubleshoot and fix problems. SECTION 3 � SCOPE OF WORK 1. Software updates/upgrades: The latest Software Version for Support and minor enhancement releases providing your existing Hardware supports the upgrade. New features are not included updates/upgrades 2. Remote access support: Remote response to most Software configuration issues and direct support for installation of Software updates 3. Unlimited Telephone support during the hours of 8:00 AM to 5:30 PM Customer�s local time, Monday through Friday excluding ScImage recognized holidays (New Year's Day, Presidents' Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day). 4. Service outside normal business hours will be billed at prevailing rates. 5. 99.99% Software Uptime Guarantee as noted in Subsection 9.6 6. One general customer review visit per year � The onsite review will take place at a mutually agreeable time, typically 12 weeks prior to expiration of the Software Support Agreement period. The purpose of the review is to identify potential malfunctions before they impact performance as well as any needed/applicable Software upgrades that pertain to preexisting Software functionality. This visit includes up to 2 consecutive days at 8 hours per day. These days can be used for system review, onsite installation or training, at the customer�s discretion. � In the event training or additional implementation is required for upgraded or new functionality, the Customer will be required to pay for implementation, travel and training expenses. **On-site visits required to support Software upgrades in excess of the one general customer review visit allowed per year will require the Customer to pay for travel. Customer to pay for any requested training outside of the one customer review visit. Unless expressly stated otherwise, Software Support Agreement Plan prices do not include any third-party hardware or software components. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. All vendors must be registered in the System for Award Management (SAM) at www.sam.gov , prior to an award of a federal contract. This action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b) and 10 U.S.C. 2304(c)(1). Interested persons may identify their interest and capability to respond to the requirement or submit quotations. This is not a request for competitive quotations; however, the Government will review any/all product, capabilities, and pricing information submitted prior to the closure of this notice. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Responsible sources that believe they possess the expertise and capabilities identified above are hereby afforded the opportunity to submit to the Contracting Officer within 10 days from the posting date of this notice, their written capabilities statement and pricing information in the format they choose, not to exceed 10 pages.
