- Description
- The NASA Shared Services Center (NSSC) announces its intention to negotiate and issue a sole-source award to Elliptical Engineering Inc, 88 Conduit Street, Annapolis, MD 21401 for annual maintenance and support for existing EllipTool� Software licenses.� The NSSC intends to execute an award with a period of performance consisting of a 1-year base period and two 1-year option periods. The EllipTool Software code has been specifically modified to meet needs of the agency.� As the original equipment manufacturer (OEM) and developer of this modified code, Elliptical Engineering is uniquely qualified to troubleshoot and update the code as the agency�s need changes. Elliptical Engineering is also uniquely positioned to provide system training and recommend software upgrades or hardware improvements.� Elliptical Engineering is the sole source provider of its proprietary software; maintenance and support must be purchased directly from the OEM to continue use and access of the software. The NSSC intends to negotiate the requirement under the authority of 41 U.S. Code � 1901 in accordance with Federal Acquisitions Regulation (FAR) 6.302-1. The NSSC will acquire commercial service items following the policies of FAR Subpart 12.1�Acquisition of Commercial Products and Commercial Services in conjunction with the policies and procedures for solicitation, evaluation and award prescribed in FAR 13.5�Simplified Procedures for Certain Commercial Products and Commercial Services.� In accordance with FAR 6.302-1(a)(2), within 14 days of a resulting award, the NSSC will publish a special notice with a redacted copy of the justification and approval for other than full and open competition.� The notice will be available at the government point of entry for a minimum of 30 days. Industry providers may identify their interest and submit a capability statement demonstrating an ability to meet this requirement. This notice of intent is not a request for competitive quotations; however, all offers and responses received within 7 business days of the issuance date of this notice will be considered by the government. A determination by the government not to compete this proposed procurement based upon responses to this notice is solely within the discretion of the government. Phone calls will not be accepted.� Any written offer or response must be received no later than 5pm Eastern Time on 22 April 2022.�
