Combined Synopsis/Solicitation Notice Combined Synopsis/Solicitation Notice Page 3 of 3 Combined Synopsis/Solicitation Notice *= Required Field Combined Synopsis/Solicitation Notice This is a combined synopsis/solicitation for Brand Name or Equal Commercial Items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation number 36C10G22Q0062 is issued for this combined synopsis/solicitation; this solicitation is being issued as a Request for Quote (RFQ). This combined synopsis/solicitation incorporates provisions and clauses in effect Federal Acquisition Circular (FAC) 2022-04 dated 30 JAN 2022. Requirement Description: VA has a requirement to purchase Pneumatic Tourniquet devices to deliver patient care at its VA Medical Centers around the country. Pneumatic Tourniquet are designed to circumferentially constrict/compress an extremity for a limited period of time by applying a precise amount of pressure using an automated gas-inflated cuff. The pressure is applied upon the limb surface and underlying tissues using the cuff; pressure is then transferred to the blood vessels causing a temporary occlusion. Pneumatic tourniquets are used mainly during surgical procedures on the extremities enabling surgeons to perform procedures in bloodless operative fields. A single award Firm-Fixed Price Requirements contract will be awarded for the purchase of Brand Name or Equal equipment in accordance with all terms, conditions, provisions, specifications, and schedule of this solicitation herein. Quotes shall contain the terms for cost/price and technical capabilities of the Brand Name or Equal equipment. The Government reserves the right to award without discussions. The associated North American Industrial Classification System (NAICS) code for this procurement is 339112 Other instruments and appliances used in medical, surgical manufacturing; Product Service Code: 6515 Medical and Surgical Instruments, Equipment, and Supplies. This procurement action is issued with FULL AND OPEN COMPETITION. This acquisition is for a single-award Firm-Fixed Price Requirements contract in accordance with FAR Part 16.5 for Zimmer® or equal Pneumatic Tourniquet and related equipment and accessories as identified in the ATTACHMENT B- PRODUCT DESCRIPTION. All interested companies shall provide a quote for all Contract Line-Item Numbers (CLINs) listed in ATTACHMENT B -Pneumatic Tourniquet- PRODUCT DESCRIPTION. This procurement effort is to establish a 12-months base contract with four 12-month option periods. Delivery is FOB destination and requires delivery to VA medical facilities throughout the United States. Firm-Fixed-Price Orders will be placed against this contract in writing and will provide the exact delivery locations, delivery dates and exact quantities. Delivery shall be provided within 30 days after receipt of order (ARO). The FAR provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition including attached addenda to the provision. The FAR provision at 52.212-2, Evaluation -- Commercial Items, and the specific evaluation criteria as attached addenda also applies to this acquisition. ADDENDUM to FAR 52.212-2 EVALUATION COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021) A. BASIS FOR AWARD The Department of Veterans Affairs (VA) Strategic Acquisition Center is issuing this Request for Quote (RFQ) to award one-year Requirements contract with four,12-month option periods. The award will be made to the responsible Quoter that represents the best value and whose quote conforms to the solicitation. FACTORS TO BE EVALUATED The Contracting Officer (CO) will award the contract based upon the following evaluation factors: Technical Price Quoters must provide a quote for every Contract Line-Item Number (CLIN) listed in ATTACHMENT A Pneumatic Tourniquet - PRICE LIST, in order to be considered for award of the contract. To receive consideration for award, a rating of Acceptable or better must first be achieved for the Technical Factor. Any quoted product that is not the exact brand name and model/product number or an equal product that does not meet and/or exceed ALL of the Salient Characteristics will be considered technically unacceptable, and thus ineligible for award. B. EVALUATION APPROACH All quotes shall be subject to evaluation by a team of Government personnel. The Government reserves the right to make an award based upon the initial evaluation of quotes. However, the Government reserves the right to communicate with any or all contractors submitting a quote if it is determined advantageous to the Government to do so. If these communications take place, the Government is not obligated to communicate with every contractor (note that FAR Part 15 procedures do not apply). Quotes will be evaluated based on the procedures authorized in FAR Part 13.106-2 and comparative evaluations of offers will be utilized. As comparative evaluations will be conducted, Vendors are encouraged to submit literature that highlights the advantages of their equipment. TECHNICAL EVALUATION: Vendors shall provide descriptive literature which will be used to determine if the quoted products are technically acceptable. Products proposed in the technical volume must be captured in the vendor s pricing volume. Quotes that merely restate the requirement or state that the requirement shall be met, without providing supporting rationale, will not be sufficient. To receive a rating of Acceptable, the quote must demonstrate the vendor s ability to meet the Salient Characteristics (SC) listed on the Combined Synopsis/Solicitation Notice/Product Description. Distributors must be authorized distributors as certified by the OEM. Only new equipment is acceptable; no remanufactured, used/refurbished or ""gray market"" items. No product in development shall be considered. All items must be covered by the manufacturer's warranty. The scope of this procurement includes being able to provide the products to all VHA facilities located in the United States (US). Delivery shall be within 30 days after receipt of order (ARO). Quoters whose quotes fail to meet all the terms of the solicitation will be rated Technically Unacceptable and thus, ineligible for award. PRICE EVALUATION: ATTACHMENT A Pneumatic Tourniquet - PRICE LIST. The Government will evaluate offers by adding the total of all line item prices, including all option years. Total price will be evaluated IAW FAR 13.106-3. This factor will not be given an adjectival rating. Quotes will be evaluated for completeness, accuracy, and reasonableness. The proposed firm fixed unit prices will be binding and incorporated in the resultant contract and utilized for all future orders placed during the term of the contract. The estimated quantities listed in ATTACHMENT A Pneumatic Tourniquet - PRICE LIST are listed for informational and evaluation purposes only and do not obligate the Government to purchase such quantity nor does the Government guarantee any volume of purchases through this contract. Price Reductions: Based on the anticipated volume of orders to be issued under this contract, quoters are strongly encouraged to provide additional discounts and price reductions from their list prices. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer, if not available in the System for Award Management (SAM). Vendors are required to complete all fill-in Provisions listed on Attachment E - Solicitation Provisions. Clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition and a statement regarding any addenda to the clause. Clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items, applies to this acquisition and a statement regarding which, if any, of the additional FAR clauses cited in the clause are applicable to the acquisition and found in Attachment C - Contract Clauses. The FAR Provision found at 52.204-7(b)(1) requires that All interested Offerors must be registered in SAM prior to submitting an offer or quotation. All SDVOSB/VOSB offerors must be verified in the Vendor Information Pages (VIP) database at: https://www.vip.vetbiz.va.gov/ at the time of quote submission.
