- This is a Sources Sought Notice (a) The Government does not intend to award a contract on the basis of this Sources Sought or to otherwise pay for the information solicited. (b) Although ""proposal,"" ""offeror,"" and contractor, may be used in this sources sought notice, any response will be treated as information only. It shall not be used as a proposal. The Government is seeking information for market research purposes only. (c) Any information received from a contractor in response to this Sources Sought may be used in creating a solicitation. Any information received which is marked with a statement, such as ""proprietary"" or ""confidential,"" intended to restrict distribution will not be distributed outside of the Government, except as required by law. (d) This Sources Sought is issued by VISN 2 Contracting Office in VISN 2, New York Harbor Healthcare System, New York, NY for the purpose of collecting information about Regulated Medical Waste Pick Up & Disposal for the VA Hudson Valley Health Care System two campuses. Castle Point Campus: 41 Castle Point Road, Wappinger Falls, NY 12590, and Montrose Campus: 2094 Albany Post Road, Montrose, NY 10548 and 7 Community Based Outpatient Clinics (CBOC). The VA is seeking to provide for this requirement as of 10/01/2022 to establish a new contract. The NAICS code identified for this requirement is 562112 - Hazardous Waste Collection. The requirement is detailed in the Statement of Work section of this document. (e) Cursory market research has identified small businesses that may be able to provide for this requirement. Contractors that are able to meet the requirements in the attachment and possess an interest in performing these service, are encouraged to email a capability statement and full information to Monique Paltan at Monique.Paltan@va.gov by 3:00 PM, May 24, 2022. - Part of the purpose of this sources sought is to determine the viability of set aside to a specific socio-economic category(service-disabled veteran owned small business, veteran owned small business, women owned small business, HUB Zone, 8(a), small business). Interested parties MUST provide company/individual name, a capability statement, examples of same or similar work performed at other facilities, Contractor s Unique Entity ID (SAM UEID) number and address, point of contact and social-economic status. If contractor is a Service-Disabled Veteran-Owned Small Business (SDVOSB), a Veteran-Owned Small Business (VOSB), or any other special category of contractors, then contractor is responsible for providing documentation in support of this. This information will be used to determine the viability of a set aside for this requirement. If any of the requested information is not supplied with the response, this may result in the contractor not being considered in the Government s Procurement Strategy. The following information is required for determining procurement strategy and viability of sources: Set aside requirements have limitations on subcontracting. This service is located in HV HCS, NY. Provide your site location and supporting documentation. Given your location and proximity to the service site, how do you plan to accomplish self-performance of this work? If your intention is to subcontract work, what tasks will be performed by you as the prime contractor? What tasks will require a subcontractor due to your inability to perform them within your company? How many years experience does your company have in performing tasks of this nature, of this scope and this complexity? How many years of service do your proposed technicians have performing tasks of this nature, this scope, and this complexity? How many years does your proposed subcontractor have in performing tasks of this nature, this scope, and this complexity? How many jobs of this nature, of this scope and this complexity have you performed in the past five years? How many certified/licensed technicians does your company currently employ? - Contractors shall also identify any Federal Supply Schedules that may carry the desired services. - Contractors shall identify pertinent point of contact for company, contractor s Unique Entity ID (SAM UEID) number for size standard and socioeconomic verification in SAM and VIP, as well as for any intended subcontractors. - Contractor shall provide 2 to 3 instances of past experience which demonstrate that they are a firm regularly engaged in this type of work, to include subcontractors for those jobs. - Contractor shall provide a listing of any teaming agreements they intend to employ in the performance of this requirement if awarded. - Contractor shall supply proof of any applicable certification or training required to meet the regulatory requirements, if applicable. - Contractors shall include any relevant comments about the Attachment(s) if applicable. Attached is the Limitation on Subcontracting Certificate of Compliance Clause. Please complete this as part of your response. STATEMENT OF WORK Regulated Medical Waste (RMW), Pharmaceutical Removal and Reusable Sharps Exchange Container Services 1. BACKGROUND: Department of Veterans Affairs, Hudson Valley Health Care System (HV HCS) is seeking pick up, disposal and exchange services of Regulated Medical Waste (RMW), Pharmaceuticals, Disposable and Reusable Sharps Exchange Services for two (2) campuses and seven (7) associated Community Based Outpatient Clinics (CBOC). 2. SCOPE: Contractor shall provide all labor and materials necessary for the collection, pick up and removal of all Regulated Medical Waste (RMW) containers, Trace-Chemotherapeutic Waste, Morgue Waste, Pharmaceutical Waste. Contractor shall provide labor and materials necessary for the collection, pick up and removal of Sharps Containers and provide Reusable Sharps Container Exchange services. All trash produced by the contractor (boxes, bags, packing materials, etc.) will be collected and removed by the contractor to a location designated by the COR. Regulated Medical Waste (RMW) must be segregated from general trash at the place where it is initially generated; the segregation must remain until final disposal has been accomplished. Never mix RMW with regular trash. 2.1 REGULATED MEDICAL WASTE REMOVAL SERVICES: Regulated Medical Waste (RMW) includes but is not limited to items contaminated with blood and body fluids/waste, chemotherapy wastes, pathological and microbiological waste, or other potentially infectious materials. The contractor shall remove full containers and replace them with an equal number of empty sanitized containers bi-weekly. Sanitizing shall be completed off of grounds. The contractor shall furnish appropriate containers, pick-up, and disposal of Regulated/Infectious Medial Waste. Pick-ups will be scheduled. If quantity increases, pick-ups shall be adjusted accordingly. Pick-ups will be made from points to be determined by each individual campus. The contractor provided containers shall be leak-proof, stackable, sealable, transportable, and designed so that government employees will not be required to lift more than 35 lbs. and shall display the universal biohazard symbol. All containers shall be always damage free and in good working order. Containers must be identifiable as to the type of hazardous waste contained within, (i.e., yellow for chemo, red for medical waste) and all containers shall be approved by the COR. The contractor will furnish containers (to be determined by site requirements) at various locations throughout the Hudson Valley VA Medical Center (Castle Point & Montrose campuses) and Hudson Valley seven (7) CBOCs accordingly as stated in this SOW. The contractor shall maintain each facility s presence neat, clean, and professional working environment at all times. Except for those items or services specifically stated to be government furnished, the contractor shall furnish and maintain everything required to perform this contract in accordance with all of its terms. Management of Regulated Medical Waste in the workplace will follow OSHA 29 CFR 1910.1030 Regulated medical waste will be disposed off-site by contractor. Use red bags (or any puncture resistant, leak resistant, uniquely colored or marked) to hold RMW. Containers shall be sealed to prevent and handled in a manner that will prevent bursting or tearing during transport. Sharps containers shall also be placed in similar containers. Liquid containers shall be placed in break-resistant and tightly sealed packages. All exterior containers used shall have the words medical waste or infectious waste or display the biohazard signage. Whenever 55-gallon drums are used to hold RMW (weather sharps or red bags), do not add fuel to drums; to do so may make final disposal more difficult or impossible. The Regulated Medical Waste (Red Bag) from the Hudson Valley facilities is to be disposed of via an incineration process rendering the waste as ash. 2.2. DISPOSABLE AND REUSABLE SHRPS EXCHANGE SERVICES: Contractor shall provide labor and materials necessary for the collection, pick up and removal of Sharps Containers and provide Reusable Sharps Container Exchange services. Contractor shall provide rigid, heavy-duty, puncture-resistant, leak-proof sharps disposal containers reusable and/or disposable, generally heavy-duty plastic with closable cover for syringes, needles, scalpel blades, and glassware used in the diagnosis of patients of the following sizes. All reusable sharps must include hardware for either wall mount (brackets or cabinets) and floor use (dollies or carts). Since the facilities increase and decrease their need throughout the life of the contact, contractors should anticipate reasonable fluctuation and shall increase and decrease as needed by each facility. Sharps are included in the medical waste and must be in reusable sharps containers approved for shipping. Use sharps containers (rigid, puncture proof, and leak proof containers, generally heavy-duty plastic with closable cover) for syringes, needles, scalpel blades, glassware used in the diagnosis of patients. Sharps waste is to be disposed of via an autoclave/shredding process; rendering the residual waste product as unrecognizable. Sharps containers utilized should be lockable/sealable eliminate human intervention while container is in service or being transported. Contractor shall provide access to spare containers at each facility in the case that a container is full in between services and EMS needs and empty container. Contractor shall provide sharps exchange services to all medical center areas to include medical wards, clinics, exam rooms, restrooms, crash/medication carts and various areas throughout the medical center. All locations as identified on the blueprints for each facility. The only areas that the technicians shall not exchange sharps containers will be isolation rooms and areas designated by the COR. All disposal and transportation of sharps (reusable and disposable) shall be as regulated medical waste and in accordance with all Federal, State, and local regulations. 3. OTHER SPECIFICATION: Regulated Medical Waste, Trace-Chemotherapeutic Waste, Pathological Waste and Reusable Sharps Waste shall be processed and disposed of off-site by contractor at a facility in compliance with all Federal, State and Local requirements. Management and processing of regulated wastes and completion of all services shall be in accordance with all Federal, State, and Local regulations. Prior to departing any Hudson Valley facility or CBOC, the contractor shall obtain the COR or designee s signature for confirmation of manifest including but not limited to: Pickup/Delivery Location, Pickup/Delivery Date, Amount of waste (number of containers picked up and/or pounds), Destruction Certification Document/Manifest Number, any other information as required by the COR. The contractor shall transport, incinerate, or otherwise dispose of material in accordance with all applicable Environmental Protection Agency (EPA), Department of Transportation (DOT), Occupational Safety and Health Administration (OSHA), and any other state and federal guidelines. 4. DOCUMENTATION FROM THE CONTRACTOR: The contractor shall prepare and submit to the COR an original signed Certificate of Destruction for each pick up for each site within 10 working days of each pickup. The contractor shall maintain proper records concerning each Certificate of Destruction issued. The Certification of Destruction shall at a minimum contain the following: Pickup/Delivery Location, Pickup/Delivery Date, Amount of waste (number of containers picked up and /or pounds), Destruction Certification Document/Manifest Number, Destruction Certification Date, any other information as required by the COR. 5. TRAINING (FOR CUSTOMER): The contractor shall provide annual training to government staff as required by the COR. Training shall include proper handling of medical/special waste; interim storage requirements, proper identification and labeling of wastes, etc. 6. TRAINING (FOR CONTRACTOR): All contractor employees and subcontractors under this contract or order are required to complete the VA s on-line Combined Privacy and Information Security Awareness Training Course and additional Privacy Awareness Training Course annually. The contractors shall provide signed certifications of completion to the COR every 12 months during each year of the contract. This requirement is addition to any other training that may be required of the contractor and subcontractor(s). 7. CONTRACTOR S RESPONSIBILITIES: The Contractor shall obtain all necessary licenses and/or permits required this work. The Contractor shall insure strict compliance with all Federal Waste Disposal Regulations, New York State Department of Environmental Conservation and New York State Department of Health Laws, all City Public Laws, and all other regulatory requirements as they apply. In accordance with the New York State Laws, the Contractor shall transport the properly completed form to the final disposal facility and surrender the form to appropriate officials for certification of destruction. The contractor will only transport the waste to a fully approved licensed and regulated facility. The contractor shall take all precautions necessary to protect persons and property from injury or damage during the performance of this contract. The contractor shall be responsible for any injury to their employees, or others, as well as for any damages to personal or public property that occurs during performance of this contract that is caused by this employees fault or negligence. The contractor shall provide a report to the Contracting Officer s Representative (COR) of pick-up, by weight, the amount of waste removed from each site on a quarterly basis from commencement of the contract. 8. QUALITY ASSURANCE: The Government will investigate complaints from any Hudson Valley VA facility. All information received will be provided either verbally and/or in writing to the contractor for appropriate action. Contractor must replace all containers that are more than approximately half to two-thirds full, to ensure no overfills between service days. Contractor must replace any/all containers which have not been filled and/or serviced in over 30 calendar days, regardless of its content or volume. Contractor should have service infrastructure to handle all applicable issues related to sharps waste disposal and service. Contractor should be able to complete all terms and conditions of the contract immediately following the award of the contract. There are to be no delays in delivering the service and/or products. 9. LICENSES AND PERMITS: Contractor shall obtain and maintain all licenses and permits for operational personnel, containers, vehicles, trailers and other resources required for proper removal of hazardous regulated Sharps and Medical waste in accordance with all applicable Federal, State, Municipal, and local regulations (e.g. Occupational Safety and Health Administration (OSHA), Drug Enforcement Administration (DEA), Environmental Protection Agency (EPA), Department of Environmental Protection (DEP) NYC, Department of Transportation (DOT)). If appropriate licenses are not maintained in accordance with Federal and State requirements, the VA may terminate the contract effective upon discovery. The VA reserves the right to halt work if the Contracting Officer and or COR determine work is being done in an unsafe/unhealthy manner or that could harm the environment. 9.1 Current Waste Transporter Permit (s): Contractor shall: List of all transfer stations, treatment, storage and disposal facilities (TSDFs) including incineration, wastewater and sludge treatment facilities that shall be utilized under this requirement to include the capacity of these facilities and the waste codes for the waste streams they are permitted to accept by treatment technology. Address, phone number, EPA identification number and other contact information shall be provided. The VA reserves the right to inspect each of these facilities before approving its use or at any time during or after contract period while VA wastes are present. 9.2 Copy of Operator Permit(s): Contractor shall provide: Certificates of training and experience of staff and/or personnel who will perform site work under this requirement (all technicians that will work on VA premises will be expected to have received at least the minimum training required by law as specified in 29 CFR 1910.120, 40 CFR Parts 260-265 and 49 CFR Parts 171-178). Contractor shall ensure all employees have the required qualifications and, if applicable, have the required current and valid professional certifications and licenses in compliance with federal, state, and local environmental requirements or laws. When requested, Contractor will provide the CO and on-site COR with information on the qualifications or certifications for employees and sub-Contractors. 10. MANIFESTING (SHIPPING PAPERS): Contactor is responsible for completing the regulated medical waste manifest prior to leaving the medical center. No regulated medical waste is permitted to leave the medical centers until a manifest is properly completed and signed by an authorized VA employee. Completed manifests confirming delivery and processing of the regulated medical waste shall be submitted monthly for the entire month. Must be within 60 days of the end of the month. Must be separated by facility then sequenced based on the date of pick-up. This will be in the form of a PDF and submitted to the COR. 11. WORKING HOURS: Normal work hours are site specific. Generally, between the hours of 7:00 AM to 9:00 PM. See Site Location for specific hours at each site. 12. POINTS OF CONTACTS FOR EACH SITE: Contractor-assigned personnel must report to Environmental Management Service (EMS) office prior to commencement of any and all work assignments. A log is provided by EMS office to record service visits as well as list concerns and problem calls. HOLIDAY RESCHEDULING: Generally, when it is necessary to reschedule a service and/or pickup because of a holiday; service and/or pickup because of a holiday; service and/or pickup must occur on the next business day following the holiday (alternate arrangements can be made with the COR and POC individual site at their discretion). 15. PERIOD OF PERFORMANCE: The Period of Performance will be 10/01/2022 to 09/30/2023 with the provision of four (4) Option Years. 16. PLACE OF PERFORMANCE: Contractor shall ensure services are performed as specified for each location. 16.1 VA Hudson Valley Health Care System - Campuses 1) HV HCS - MONTROSE CAMPUS 2094 Albany Post Road Montrose NY 10548 Montrose Campus: Contractor will pick up once a week on Thursday Between 7:30am 4:00pm unless otherwise instructed. If a holiday should fall on a schedule pick up day, pick up will be on the next business day. Estimated 20-25 containers per pick up. Containers will be located loading dock Bldg. 12. Contractor will not be allowed access to the Medical Center grounds prior to 7:00 AM or after 4:00 PM, except in a Medical Center recognized emergency situation. 2) HV HCS - CASTLE POINT CAMPUS Route 9D Castle Point, NY 12511 Castle Point Campus: Contractor will pick up once a week, on Tuesday between 7:30 AM 4:00 PM unless otherwise instructed. If a Holiday should fall on schedule pick up day, pick up will be on the next business day. Estimated 20-25 containers per pick up. Containers will be located on the loading dock of Bldg. 18. Container will be located in the housekeeping closet. 3) VA GOSHEN CBOC 30 Hatfield Lane, Suite 204,205 & 206 Goshen, New York 10924 Goshen CBOC: Contractor will make pick up of one container on the 3rd and 4th Thursday of every month between the hours of 9:30 AM and 11:00 AM. Container will be located in housekeeping closet. 4) VA MONTICELLO CBOC Jefferson Professional Plaza Unit 3 60 Jefferson Street Monticello New York 12701 Monticello CBOC: Contractor will make pick up of one container on the 2nd Tuesday of every month between the hours of 8:00 AM and 4:40PM. Container will be located in housekeeping closet. 5) VA NEW CITY CBOC 345 North Main Street, 1st Floor New City, New York 10956 New City CBOC: Contractor will make pick up of one container on the 3rd Thursday of every month between the hours of 9:00 AM and 5:00 PM. Container will be located in housekeeping closet. 17. VHA SUPPLEMENTAL CONTRACT REQUIREMENTS: VHA Supplemental Contract Requirements for Combatting COVID-19 1. Contractor employees who work in or travel to VHA locations must comply with the following: Documentation requirements: If fully vaccinated, contractors shall show proof of vaccination. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination. If unvaccinated, contractors shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor s order or an FDA approved over-the-counter test that includes an affiliated telehealth service. Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel. Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. 2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information. 3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities. 4. For indefinite delivery contracts: Contractor agrees to comply with VHA Supplemental Contract Requirements for any task or delivery orders issued prior to this modification when performance has already commenced.
