Description
NOTICE OF INTENT TO SOLE SOURCE The US Environmental Protection Agency is issuing this Notice of Intent (NOI) to inform industry contractors of the Government�s intent to execute a Sole Source Purchase Order Award under the Acquisition of Commercial Items procedures pursuant to FAR Part 12 in conjunction with the Simplified Acquisition Procedures of FAR Part 13, specifically the authority of FAR 13.106-1 (b)(1) allowing the Contracting Officer to solicit from one source for a Chemical Inventory Management Software License renewal contract, which includes maintenance, service, and specialized equipment for Region 1. The intended Contractor is AT/SCAN LTD d/b/a Vertere, 77 Morgan ST. , Portsmouth, Rhode Island. EPA believes Vertere. is the only responsible source capable of meeting this requirement. No solicitation or Request for Quotes is available. This is a sole source procurement of a reoccurring annual service and maintenance contract renewal for the Vert�re Inventory Manager Software, including software upgrades, technical support, training and required equipment for the establishment of a new EPA site. This multi-module enterprise system allows for site specific setup accommodating to the unique objectives and needs of each EPA location. The system provides a comprehensive way to manage the tracking of equipment and chemicals throughout the facility. The physical data, safety and regulatory information are available to ensure inventories are managed properly. Finally, the system�s ability to be customized allows for the development of reports designed to easily respond to internal and external inquiries. The Safety Health and Environmental Management Division provides access to automated chemical and laboratory equipment inventory management to 20 of the Agency�s laboratories. The maintenance, service and equipment needed to establish the system at a new EPA location for this web-based system is provided by Vert�re Inventory Control Systems. Vert�re Inventory Control Systems will provide access, service, upgrades, and maintenance for their proprietary system via the internet. The contractor will be responsible for providing updates and software support to the continued use of this software that ensures continuity, compatibility, and integrity of data currently used throughout the EPA. There are no known resellers. As a result, the EPA intends to negotiate exclusively with AT/SCAN LTD d/b/a Vertere. Vert�re Inventory Control Systems has provided access to their proprietary software which uses its exclusive partnership with Chemical Data Corporation and Zebra Technologies to produce an integrated system which allows locations to properly management inventories and meet regulatory requirements. Vert�re is the sole owner and retains all rights to this inventory control system. Using the Vert�re system helps the EPA maintain the safety and health requirements associated with 3�f5 managing laboratories and conducting emergency operations. The ability of headquarters as well as the sites to retrieve data on the use and the storage of hazardous chemicals and eliminate unnecessary purchases and waste disposal ultimately reducing cost. The contractor must meet all of the requirements below: Vert�re Inventory Control Systems is the only know contractor who meets these criteria. a) Must be able to provide upgrades for the current Vert�re Inventory Manger software installed at EPA locations. b) Must be able to provide training on the features and use of the modules of the Vert�re Inventory Manager c) Must be able to provide technical support for all EPA sites using the Vert�re system This action will result in a Firm-Fixed Price (FFP) Purchase Order (PO) with a period of performance, including a reinstatement period, through March 31, 2023, with two � (2) one-year option periods. The North American Industry Classification System (NAICS) for this requirement is 511210 - Software Publishers. The Product of Service Code for this requirement is DA10 - IT and Telecom � Business Application/Application Development Software as a Service. The Small Business Administration (SBA) size standard for this sector is $41.5 Million. OPTIONAL: Additional Software Technical Service Cost for consolidation of existing multiple database installation for 20 separate sites into a single EPA-managed database installation (Minimum $25,000; Not to Exceed at 238 hours) This notice of intent is neither a formal solicitation nor a request for competitive proposals. No solicitation document is available and telephone requests will not be honored. No award will be made on the basis of unsolicited quotations or offers received in response to this notice. Any response to this notice must show clear, compelling and convincing evidence that competition will be advantageous to the Government. The intent of this synopsis is for informational purposes only. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this action based on this notice is solely within the discretion of the Government.
