DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: _______ 36C250-22-AP-1300___________________________ Contracting Activity: Department of Veterans Affairs, VISN 10, Dayton, Chillicothe, Cincinnati Medical Centers and Chalmers P. Wylie VA-ACC (Columbus). 2237 s Chillicothe; 538-22-3-4041-0012 Cincinnati: 539-22-3-6083-0034 Dayton: 552-22-3-6115-0024 Columbus: 757-22-2-621-0313 Nature and/or Description of the Action Being Approved: Action will be awarded as a Firm-Fixed price, 1 year contract. Rationale for the decision to sole-source to an SDVOSB is due to the logistical and financial concerns that a company faces with our current supply chain (re, collection bins). Current plan is to award a 1-year contract with the intent to perform a solicitation for the follow-on contract immediately upon award to provide ample time for ramping up for the awardee. Description of Supplies/Services Required to Meet the Agency s Needs: Vendor to provide weekly and monthly pickup and destruction of contents of onsite shredding bins for Dayton, Chillicothe, Cincinnati, and Columbus VA s and CBOC s. Due to the sensitive nature of this requirement (PII and HIPAA security risks) it is classified emergent in nature. Period of performance for this acquisition shall be 5/11/22 5/10/2023. Estimated value of this requirement is $479,639.96. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below: (x) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or ( ) 819.7008 Sole source awards to a verified veteran-owned small business Demonstration that the Contractor s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): In accordance with VAAR 819.7007 and VAAR 819.7008 CO s have the authority to sole source awards to SDVOSB/VOSB based on 38 U.S.C. 8127(c) and that the SDVOSB/VOSB concern has been determined to be a responsible source with respect to performance. The vendor has been performing the requirement as a subcontractor and is registered in SAM and verified as a SDVOSB in VIP. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies: Due to unexpected circumstances the previous contract option was not exercised. There was not enough time to issue a formal solicitation and ramp up of all the required collection bins. This contract is being put into place in order to provide sufficient time to solicit and provide time for ramp up to the SDVOSB awardee. SDVOSB Vendor receiving the one-year contract award was the subcontractor of current contract, vendor has the opportunity to secure all bins and cabinets that are currently being utilized for the contract. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Verification of GSA pricing for VIP certified SDVOSB s provided guidance that provided quote was fair and reasonable. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research showed 1 SDVOSB and 1 SB in our state that were willing and able to supply a quote for services. Queried VIP (PSC R614 & strict Ohio) 1 Result. Any Other Facts Supporting the Use of Other than Full and Open Competition: None, 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Chermat Holdings dba. Black Op s Destruction (VIP Certified SDVOSB) A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Future barriers will be removed through natural solicitation and competition. This is a unique situation that is further exasperated by the supply chain limitations due to COVID-19. Immediately after this requirement is awarded the 1-year contract we plan on re-competing a base and 4 option year contract follow-on to start 5/11/2023. The award date should be within 120 days of the awarded 1-year contract.
