- The United States Department of Commerce (DOC), National Oceanic & Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Western Acquisition Division (WAD) intends to award a Firm-Fixed Price (FFP) Commercial Supply contract in accordance with FAR Part 12, on a Sole Source basis in accordance with 41 U.S.C. 1901, using Simplified Acquisition Procedures (SAP) up to $7.5M as authorized by FAR 13.500(a) and implemented by FAR 13.501(a). The North American Industry Classification System (NAICS) code for this proposed contract action is 221310 with a business size standard of $30mil. Only one source is determined to be reasonably available to perform this acquisition. The University of California San Diego (UCSD) is the only known source that can provide the seawater to the NOAA Southwest Fisheries Science Center (SWFSC) laboratory aquarium located on the Scripps Institution of Oceanography (SIO) campus. The seawater pumped from SIO to the SWFSC�s experimental aquarium and technology tank allows the SWFSC to accomplish its mission of conducting research on the conservation and management of living marine resources. The seawater provided by the UCSD currently being pumped into the SWFSC�s laboratory and is not considered to be �open-source.� Therefore, it is not practicable to procure seawater on a competitive basis at this time. Deliverables: The seawater is delivered at a flow rate of 80 gallons per minute for a total of 42,048,000 gallons per year. The seawater is pumped from the intake at the end of the SIO Pier; flows through the SWFSC experimental aquarium and returned to the ocean via the SIO�s seawater outfall. This notice of intent is not a formal solicitation or request for competitive proposals. No solicitation document is available and telephone requests will not be accepted. No award will be made on the basis of quotations or offers received in response to this notice. Interested parties may submit their written interest and capabilities no later than Tuesday, May 31, 2022 2:00 PM Pacific Standard Time. E-mail statements will be accepted but senders are responsible for ensuring the complete transmission and timely receipt. All inquiries shall be sent via e-mail to: mona.m.ash@noaa.gov. Potential contractors responding to this notice must have a current and active registration in the System for Award Management (SAM). The Government intends to award a contract with a one year base period and four one-year option periods for seawater supply to the University of California San Diego (UCSD). The intent of this synopsis is for informational purposes only. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement for future requirements. A determination by the Government not to compete this action is based on this notice and solely within the discretion of the Government.
