- The Naval Air Systems Command intends to issue a new Delivery Order under Basic Ordering Agreement or award a new contract on other than full and open competitive basis to Raytheon Company in McKinney, TX for Helicopter Night Vision System (HNVS) AN/AAQ-44A Forward Looking Infrared System (FLIR) Kits for Lots 9 through 13. �The contract approach for FLIR Lots 9 through 13 may consist of a multi-year procurement (MYP).� PMA-261 intends to submit a multi-year procurement request in accordance with Title 10 United States Code (U.S.C) 2306b in order to pursue a five-year fixed price type contract for FLIR Lots 9 through 13. �In addition, upon receipt of authorization, Economic Order Quantity funding may be obligated in conjunction with a multi-year procurement.� This procurement will include up to 180 HNVS AN/AAQ-44A� FLIR Kits, components, associated equipment and support comprised of special tooling, support equipment, test equipment, training equipment/services, sustaining engineering, repair of repairables, repair analysis, non-recurring and recurring engineering associated with engineering changes, publications, technical data, cost reduction initiatives, parts obsolescence, quality assurance, reliability and maintainability logistics support, publications, unit tear down/inspection/re-build/repair, test and delivery, and technical, administrative and financial data required to build and maintain the CH-53K FLIR System.� The authority permitting other than full and open competition is Title 10, U.S. Code 2301(c)(1), as implemented by the Federal Acquisition Regulation Part 6.302-1(a)(2), in that Raytheon is the only responsible source and no other type of equipment will satisfy Marine Corps requirements.� As the sole designer, developer, and producer of the CH-53K FLIR, Raytheon is the only source that has unrestricted access to the totality of technical data and repair facilities/ special tooling needed to support the requirement herein. Further, the Government does not possess adequate license rights to the required technical data package necessary to support a competitive procurement to fulfill the requirement herein.� Companies interested in subcontracting opportunities should contact Brittany Santiago at brittany.santiago@raytheon.com. Note:� The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302.� This notice of intent is not a request for competitive proposals. However, any capability statements received within fifteen days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
