Description
This Special Notice supplements and updates prior SAM.gov special notices issued by the Office of the Comptroller of the Currency (OCC), pertaining to safety protocols for federal contractors. OCC will continue to share any guidance or procedures via SAM.gov or through other appropriate means, including signage at its buildings and facilities. The Office of the Comptroller of the Currency (OCC) is providing updated guidance on its current and expected operating procedures applicable to Executive Order (EO) E.O. 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors; Safer Federal Workforce Task Force (Task Force) guidance (Guidance); Federal Acquisition Regulatory (FAR) Council; and Office of Federal Procurement Policy (OFPP). CURRENT PROCEDURES: Contractors meeting any of the below COVID-related criteria are prohibited from reporting to their OCC worksite and must notify their company point of contact and follow their company�s health procedures or guidelines. The criteria include: Test positive for COVID-19, Been diagnosed by a doctor as infected by the virus but not tested, Had close contact with somebody who tested positive for COVID-19, and/or Traveled internationally (officially or personally) to locations designated as �Level 4 � COVID Very High� within the last 14 days. Company representatives should immediately notify their OCC contracting officer (CO) and contracting officer�s representative (COR). They should provide the names of any OCC employees or other contractors at the worksite who may have been in close contact with the affected contractor. The COR/CO will share the confidential information through established agency reporting channels. The OCC does not collect, track or monitor any contractor health information in any system of record.� Vaccination/Testing: For onsite (badged) contractors, the OCC requests that the contractors please verify the vaccination status and/or negative COVID test within the last 3 days, of their employees, prior to entering OCC space. However, onsite contractor employees are still required to show their attestation form and/or negative COVID test (and maintain on their person), should OCC officials request to view the information. The OCC does not collect this vaccination information from contractors. Vaccination attestation and proof of a negative COVID-19 test are not required for onsite contactor employees when the COVID-19 Community Level is LOW in a county where an OCC facility is located.� In areas with a MEDUM or HIGH COVID-19 Community Level , the requirements for both vaccination attestation and proof of a negative COVID-19 test are required for onsite contractors. The requirement for vaccination attestation requires use of OMB�s Certification of Vaccination Form. Mask Wearing: Masks are optional for fully vaccinated contractors in areas with LOW or MEDIUM in a county where an OCC facility is located.� COVID-19 FAR CLAUSE: A federal judge has issued a preliminary injunction that temporarily blocks the Biden Administration�s coronavirus/COVID-19 vaccine mandate for contractors and subcontractors across the country. Therefore, until further notice, the OCC will not take any further action(s) to implement or enforce FAR clause 52.223-99, �ENSURING ADEQUATE COVID-19 SAFETY PROTOCOLS FOR FEDERAL CONTRACTORS (OCT 2021) (DEVIATION).� The OCC reserves the right to revise its safety protocols and procedures at any time to promote the health and safety of its workforce. � GOVERNMENTWIDE COVID GUIDANCE AND UPDATES OCC contractors are encouraged to continue monitoring the Safer Federal Workforce Task Force Guidance at http://www.saferfederalworkforce.gov/contractors/�and FAQs for any updates.
