- The Department of Veterans Affairs intends to solicit and negotiate a Sole Source, Firm-Fixed Price Purchase Order with one source, MGC Diagnostics. The procurement is for on-site, full-service maintenance and repair to ensure a variety of MGC pulmonary and cardiac diagnostic systems are kept in proper operation condition, have the latest compatible software operational and are ready to use. This includes software and firmware updates, all parts and service to properly provide preventative maintenance, diagnostics, phone support, on-site repairs and software updates. This procurement will be made under the authority of Title 41 U.S.C. 3304(a)(1) as implemented under FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. In accordance with FAR 6.302-1 the Contracting Officers determination whether to make a sole source award is a business decision wholly within the discretion of the Contracting Officer. This notice satisfies the requirement at FAR 5.201(b)(1), to publicize the proposed contract action. This notice of intent is not a request for competitive proposals and no solicitation will be made available. Any responses received will only be considered for the purposes of determining the marketplace for future procurements. The Government will not pay for information submitted. This will be the only notice of the Government s intent to solicit, negotiate and award to one source to satisfy this requirement.
