Part 806.3 Other Than Full and Open Competition (OFOC) Attachment 7: Request for Sole Source Justification Format >SAT Rev: 13 Effective Date: 02/01/22 Page 1 of 4 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID:__36C255-22-AP-3052__________________________________ Contracting Activity: Department of Veterans Affairs, VISN 15, Kansas City Medical Center 2237-589-22-3-1792-0146 Nature and/or Description of the Action Being Processed: Vendor will be required to provide only OEM authorized services and repairs on existing equipment that were damaged in the operating room flood at the Kansas City VAMC. During limited market research, it was found that the only OEM specified repairs and repair parts are provided solely by the OEM. No other repair facilities were found that would have the parts, expertise, and approval from the OEM. Skytron is the only source that is able to provide the repairs on their lighting systems due to the specialized nature of the equipment. The estimated value of this procurement is $32,295.40 Description of Supplies/Services Required to Meet the Agency s Needs: This procurement will provide the installation services replace the damaged parts for the Skytron lights that were damaged in the OR flood. Statutory Authority Permitting Other than Full and Open Competition: . (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3; ( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4 ( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5; ( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6; ( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Skytron lighting system that was damaged is highly specialized equipment. Skytron is the only source that can provide the replacemet parts and the personell to repair their lighting system. If the system were to be completely replaced instead of repaired the costs would be substantially higher and incur unacceptable delays by keeping one OR room out of service for an extended period of time. Accordingly, Skytron is the only firm capable of providing the supplies and services described in Section III above without the Veteran s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to Skytron being the only source available for th e parts and repair an offer was only solicited form them. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost will be considered fair and reasonable based on the quote being found acceptable by the COR with the knowledge of the market. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: During market research we performed an internet search through multiple search engines for repairs on our specific equipment. No repair companies were found during this search. We then contacted the local representative for this device and found that they do not utilize any other vendors to perform repairs on their equipment as each piece is engineered to function in the space where it is installed. This is a technical installation and they do not advise any other company to provide these services.
