COMBINED SYNOPSIS/SOLICITATION FIRE AND SMOKE DAMPER INSPECTION AND TESTING LYONS VA MEDICAL CENTER (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items, and FAR 13.5 Simplified Procedures for Certain Commercial Items as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued. (ii) This solicitation is issued as a request for quote (RFQ). Request for Quote will be submitted through beta.sam.gov on RFQ reference number 36C24222Q0890. (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-06 (eff. 05/26/2022), VAAR 2008-32 (eff. 11/01/2021). (iv) This solicitation is a Total Service-Disabled Veteran-Owned Small Business set-aside open market solicitation. The associated North American Industrial Classification System (NAICS) code for this procurement is 541990- All Other Professional, Scientific and Technical Services and has a small business size standard of $17 Million. The FSC/PSC is H312 Inspection Fire Control Equipment. (v) This is a services contract to provide FIRE AND SMOKE DAMPER INSPECTION AND TESTING. Below is a template for pricing. Contractors may provide their own pricing document, but it must be broken down to allow for price reasonableness determination. PRICING TABLE FOR: FIRE AND SMOKE DAMPER INSPECTION AND TESTING LINE ITEM DESCRIPTION QUANTITY UNIT UNIT PRICE TOTAL PRICE 0001 BASE PERIOD: Contractor shall inspect, clean and test 499 dampers at the Lyons VA Medical Center. 499 JB 0002 Labor costs JB Total Base Year: Base and All Option Years Total: (vi) The required work is as contained below in the Statement of Work. STATEMENT OF WORK VA New Jersey Healthcare System 151 Knollcroft Road Lyons, New Jersey 07939 A. GENERAL INFORMATION 1. Title of Project: FIRE AND SMOKE DAMPER INSPECTION AND TESTING at the Lyons VA Medical Center, 151 Knollcroft Road Lyons, N.J. 07939 2. Background: As per Life Safety Codes, NFPA 80; Standard for Fire Doors and Other Opening Protectives, current edition and NFPA 105 current edition; the facility needs its fire dampers tested, operated and cleaned every 4 years. A complete list of dampers will be provided to the contractor upon request. 3. Scope of Work: a. Contractor shall prepare site for testing of listed fire dampers and furnish supervision, labor, equipment, and materials to perform work as required by NFPA. Coordinate with COR (Contracting Officers Representative) and VA Fire Department and place fire alarm system in ""test mode"" if necessary to conduct inspection of the smoke and/or combination dampers. The contractor shall provide all resources necessary to accomplish the services as described in the statement of work (SOW) except as may otherwise be specified by the Contracting Officer. b. VA Engineering department will provide an inventory of all fire dampers that are required to be tested. Test all operable fire dampers as outlined by NFPA codes. There are 499 dampers to be tested. c. Contractor must digitally photograph each Damper ""before"" and ""after"" inspection, operate, clean, lubricate (with approved lubricant and test every damper in accordance with NFPA 80 chapter 19). Contractor shall provide a new fusible link of equal rating if broken or defective ones are found during the inspection (per National Fire Protection Association Code). Manually activate actuators on electric and pneumatic smoke and/or combination dampers to verify proper operation of each damper. d. Contractor must provide report detailing: the location of the fire damper, date(s) of inspection, name of inspector, and deficiencies discovered. This report shall be provided within 14 calendar days of completion of the inspections. e. Contractor must provide separate report detailing how to fix each failed damper and a cost to do the work. The report will also show inaccessible dampers and the cost to make them accessible. This report shall be provided within 14 calendar days of completion of the inspections. f. The Medical Center must maintain its operation 24 hours a day 7 day a week. Therefore, any interruption in service must be scheduled and coordinated with the Contracting Officer s Representative (COR) to ensure that no lapses in operation occur. It is the contractor s responsibility to develop a work plan and schedule. The schedule must detail at a minimum, the procedures to be employed, the equipment and materials to be used. The schedule must also detail the interim life safety measure to be used during the work and a schedule defining the duration of the work with milestone subtasks. The schedule shall be in the form of a progress chart of suitable scale to indicate the work scheduled for completion by any given date during the work period. The proposed schedule shall be reviewed by the COR. Any requirements for adjusting the schedule (e.g., to minimize disruption to the VAMC) shall be incorporated by the Contractor. g. In the unlikelihood that some of the work may be required to be done off hours or on weekends. These off hours must be coordinated and scheduled with the COR prior to being worked. Any unauthorized overtime or off hour work will be considered inclusive. h. Place identification stickers on ceilings or other location to assist in locating all dampers in subsequent inspections. 4. INSPECTION REPORT: a. Upon completion of testing and inspecting, the vendor will provide the COR with an electronic report intended to provide Customer evidence of Damper inspection for submission to applicable agencies, such as JCAHO and NFPA. The Report should include the following information: A listing of the location of each Damper, Damper's number, and whether each Damper passed or failed; if a Damper failed, a detailed explanation of the reason for failure shall be provided. Digital photographs of each Damper before and after cleaning and inspection. The COR/POC will perform the inspection in the presence of the contractor personnel prior to the contractor personnel leaving the facility. No invoices will be processed for payment prior to the completion of POC inspection. Contractor must report deficiencies that are deemed critical or catastrophic to the Contracting Officer and the COR for immediate actions 5. Qualifications of Contractors: STANDARDS OF SERVICES IN A HOSPITAL/PSYCHIATRIC ENVIRONMENT. a. Contractor shall adhere to NFPA 80 Standard for Fire Doors and Other Opening Protectives , current edition and NFPA 105 current edition. b. Contractor must have at least 5 years of experience for the proposed work. c. Contractors must have safety training either on-the-job or classroom type. Prior to commencing work, general contractor must provide proof that an OSHA certified competent person (CP) (29 CFR 1926.20(b)(2) will maintain a presence at the work site whenever the general or subcontractors are present. All employees of general contractor or subcontractors shall have the 10-hour OSHA certified Construction Safety course. d. Submit training records of all such employees for approval to the VA Contracting Officer prior to work. e. Contractors shall have and provide all necessary tools, equipment, and Personal Protective Equipment (PPE) to perform the work safely, effectively, and timely. f. The vendor must provide a completed fire and safety risk assessment. A copy of the blank form will be provided upon request. g. The vendor must perform the Inspection Services in a workmanlike manner. All tools are to be carefully maintained so as not to provide a danger to residents. All tools and materials will also be maintained so as not to provide an opportunity for a resident to cause harm to himself or others. h. The vendor must make its employees aware of the unique environment that they are working in. There are Locked Units with Acute Psychiatric Patients and special care must be taken. 6. Other Related Services (Not Included in Statement of Work): Any services not expressly stated in this statement of work are not authorized. Services such as inspection, Original Equipment Manufacturer (OEM) required maintenance, or other maintenance and repair vital to the continued functioning of the systems may be added only after written modification from the Contracting Officer, unless they are inclusive to the requested services. No other person, including the COR or any other VA personnel are authorized to request additional work be performed by the contractor. Any additional services performed that are not authorized by the Contracting Officer shall be considered inclusive. 7. Other Requirements: The contractor shall: Be a firm regularly engaged in the inspection, testing, and servicing of dampers as described in this Statement of Work. Have expertise, experience, and regular business to include inspection, testing, and servicing of the system components. Possess all the manpower, equipment, tools, and ready sources of parts as necessary to carry out the conditions of the requirement promptly, skillfully, and expertly 8. Safety Requirements: All work shall be performed in accordance with: NFPA 72: National Fire Alarm and Signaling Code. NFPA 70E: Standard for Electrical Safety in the Workplace. NFPA 70: National Electrical Code Articles 517, 645 & 800. NFPA 77: Recommended Practice on Static Electricity. NFPA 80: Standard for Fire Doors and Other Opening Protectives NFPA 99: Healthcare Facilities. NFPA 101: Life Safety Code. NFPA 105: Standard for Smoke Door Assemblies and Other Opening Protectives. Contractor must follow all VA, OSHA, and EPA safety policies as applicable. The Contracting Officer or his/her designee shall notify the contractor of any noncompliance with the foregoing provisions and the action to be taken. The Contractor shall, after receipt of such notice, immediately correct the conditions to which attention has been directed. Such notice, when served on the Contractor or his/her representative at the site of the work, shall be deemed sufficient for the purpose aforesaid. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all and any part of the work and hold the Contractor in default. 9. Inspection: Upon completion of services, the COR/POC shall perform the inspection in the presence of the contractor personnel, prior to the contractor personnel leaving the facility. This inspection shall ensure that the system is returned to full functioning condition No invoices shall be processed for payment prior to the completion of POC inspection. 10. Working Hours: All scheduled work shall be performed between 7:00 a.m. and 4:30 p.m. EST, Monday through Friday, excluding Federal Holidays. Holidays observed by the Federal Government are: New Year s Day Martin Luther King s Birthday President s Day Memorial Day Juneteenth Independence Day Labor Day Columbus Day Veteran s Day Thanksgiving Day Christmas Day And any other day specifically declared by the President of the United States to be a national holiday. Any service that will affect the delivery of patient care shall be scheduled with the COR prior to performance. 11. Estimated Period of Performance: 08/1/2022 - 09/30/2022. Estimate schedule is to be completed no more than 60 Business days from date of award, unless otherwise directed by the Contracting Officer (CO). 12. This Technical description should address the requirement specifically. Capability statements that are merely an overview of what the contractor offers will be determined incomplete. Please address all the technical evaluation sub-factors. Failure to address all the sub-factors will result in your package being determined incomplete; Terms of any express warranty; Price should be for all services detailed in section v of this document. The pricing must be broken down in a manner that allows for price reasonableness to be determined. Failure to provide complete pricing will result in contractors package being determined to be incomplete; Remit to address, if different than mailing address; A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically); Acknowledgement of any solicitation amendments; Past performance information; A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representation or information or reject the terms and conditions of the solicitation will be excluded from consideration. The following solicitation provisions are included as addenda to FAR 52.212-1: 52.252-1 Solicitation Provisions Incorporated by Reference (FEB 1998) 52.204-7 System for Award Management (OCT 2018) 52.204-16 Commercial and Government Entity Code Reporting (Aug 2020) 852.252-70 Solicitation Provisions or Clauses Incorporated by Reference (JAN 2008) ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES . Offer submissions must include: Offeror capability statement of no more than 10-pages that demonstrates that the offeror is a firm regularly engaged in fire damper inspection, cleaning and testing. Capability statement must address offeror proficiency and risk mitigation. At least 3-5 instances of past experience of similar scope and complexity within the past 5 years. Past experience information must include agency or company work was performed for, duration of contract, description of worked performed, and dollar value. Offeror must provide 10-hour OSHA training certificate. (ix) The provision at FAR 52.212-2, Evaluation Commercial Items (NOV 2021), applies to this acquisition. Award shall be made to the contractor whose quotation offers the best value to the government, considering technical capability, past performance, and price. The Government may perform a comparative evaluation (comparing offers to each other) to select the contractor that is best suited and provides the best value, considering the evaluation factors in this solicitation. The government shall evaluate information based on the following evaluation criteria. Evaluation Factors: (1) Technical capability - Contractor will be evaluated on how well they meet all the requirements of the statement of work. a) Technical Proficiency: Contractor will be evaluated on how well they meet the requirement to demonstrate their understanding of the requirement in accordance with the Statement of Work and the extent to which potential risks are identified and mitigated. b) Contractor Experience: Quoter will be evaluated on how well their past experience information supports that they are a capable vendor who can adequately perform services of this scope and complexity without issues with performance. Relevant past experience information shall include at least 3-5 instances of past experience of similar scope within the past 5 years. If offeror does not have 3-5 instances of similar scope, they must provide past experience of lesser scope. The contractor must demonstrate they are a firm regularly engaged in the testing, cleaning and inspection of damper system components described in the Statement of Work. Having no past experience will be rated as high risk. c) Training: 10-hour OSHA certified Construction Safety course. Contractor must be familiar with requirements of section 8 of SOW. (2) Past performance: Contractor will be evaluated on how well they performed on past contracts of similar scope and magnitude. Contractors without contracts of similar scope will be evaluated on performance on contracts of lesser scope. Contractors with no Past Performance will receive a neutral rating. Evaluation will be based on contractor provided information that must include key personnel who have the relevant experience, point of contact information for references, predecessor companies and subcontractors. The contractor s information shall also be reviewed in PPIRS. (3) Price: The government will evaluate offers for award purposes based on the pricing for the total requirement. Offers for partial requirement will not be evaluated and will be deemed non-responsive upon receipt. (a) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Failure to provide the information requested in the evaluation criteria may result in being found non-responsive. The government intends to award a contract as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows: ""The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition."" OR ""The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:"" Quoter shall list exception(s) and rationale for the exception(s).
