- THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Office of intends to award a sole source contract under the authority of Federal Acquisition Regulation (FAR) Subpart 13.106-1 (b) Soliciting from a single source. For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. This contract(s) will be awarded to 10x Genomics, Inc. 6230 Stoneridge Mall Road, Pleasanton, California, 94588-3260 for the purchase of 10X Multiple kits for Genomics 5� GEMS library preparation. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 334516 with a Size Standard of 1,000. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2022-06 dated May 1, 2022. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The National Institute of Neurological Disorders and Stroke (NINDS) is a part of the National Institutes of Health (NIH), conducting research into the causes, treatment, and prevention of neurological disorders and stroke. The chromium Next GEM single cell 5' GEM v2 kits are required to unveil single cell transcriptional changes in patients with PML compared to healthy controls, as well as expansions in the T and B cell receptor repertoires associated with immune involvement of a virally-mediated disease. These 10X sequencing reagents are needed as part of a single cell RNA sequencing study of progressive multifocal leukoencephalopathy (PML) patient populations within the Neuroimmunology Branch of NIH. Results from this study will be used to correlate single cell sequencing data with clinical presentation and other immunological assays. The purpose of this acquisition is to prepare the necessary gene expression, T cell receptor and B cell receptor libraries necessary for sequencing and subsequent data analysis. Currently, the Chromium Next GEM single cell 5� GEM kits, plus supplemental TCR and BCR enrichment kits, are the only standardized kits on the market designed for sequencing of single cells plus enriched immune cell profiles. This order will be used for the preparation of libraries for sequencing of 14 patient samples over the course of 6 months. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. The essential characteristics of the kits limit the availability to a Brand Name Only. 10x Genomics, Inc. is the only company manufacturing the Chromium Next GEM Single Cell 5' Library and Gel Bead Kit v2, 16 rxns compatible with the 10X genomics chromium controller owned by the Viral Immunology section of NINDS. Additionally, these kits will be used in several ongoing research projects and are critical to maintain the integrity of the research. Therefore, only 10x Genomics, Inc. is capable of meeting the needs of this requirement. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Unique Entity ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.
