Page 4 of 5 Page 1 of 3 Page 1 of INTENT TO SOLE SOURCE: PROCUREMENT OF ONE (1) TIMS 2000 SP CPU UPGRADE THIS IS A NOTICE OF INTENT TO SOLE SOURCE FOR ONE (1) TIMS 2000 SP CPU UPGRADE TO THE BOSTON VA MEDICAL CENTER INTENT TO SOLE SOURCE FOR PURCHASE REQUISITION: This is not a request for competitive proposals. This is not a solicitation or request for offers. No solicitation package is available and telephone requests will not be honored. The Department of Veterans Affairs Medical Center intends to award a one-time, Firm Fixed Price, Sole Source contract for One (1) TIMS 2000 SP CPU to be delivered to VAMC Boston Jamaica Plain Division to the SB (Small Business) Original Equipment Manufacturer (OEM) Foresight Imaging LLC. Technology, knowledge, technical expertise, and servicing capabilities for the TIMS DICOM system and the TIMS Trade-in program are proprietary to Foresight Imaging LLC. A Sole Source Letter was provided by the Original Equipment Manufacturer (OEM) describing the proprietary nature of the TIMS DICOM system and TIMS Trade-in program establishing this requirement as being peculiar in distribution to Foresight Imaging LLC. The letter states that only the Foresight Imaging LLC is authorized to perform the CPU Upgrade and Trade-in. The authority for applying the Simplified Acquisition Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901. This statute is implemented by for restricting competition on this procurement via FAR 8.405-6(a)(1)(i)(B). The intent is to procure these products on a sole source basis. No solicitation will be posted to Contract Opportunities. The primary North American Classification System Code (NAICS) is 339112: Surgical and Medical Instrument Manufacturing. The most current Business Size Rating for this NAICS is 1000 employees. Capable parties may identify their interests and authorization to respond to this requirement by August 11th, 2022, at 11:00 AM (EDT). A determination by the Government not to compete this proposed award upon response to this notice is solely within the discretion of the Contracting Officer.
