- Description
- The Naval Surface Warfare Center Panama City Division, FL (NSWC PCD) intends to award a sole source BPA using simplified acquisition procedures to Red Six Solutions for UAS Piloting and Support. This procurement is sole source for the following reason: The sponsor for this effort, the Transportation Security Administration (TSA) is working in coordination with the Department of Homeland Security (DHS) to utilize Red Six Solutions for site and vulnerability assessments which will be utilized to develop an application for a Certificate of Authorization (COA) from the Federal Aviation Administration (FAA). The COA provides authorization for specific pilots to fly specific UAS in specific flight patterns. As Red Six Solutions develops the COA application and receives the authorization, they will have inherent awareness that other vendors will not have. Destination to the Naval Support Activity Panama City (NSA PC), Receiving Office Building 100, 100 Vernon Ave., Panama City, FL 32407. Small Business Size standard $30.0M, NAICS Code 611512. PSC is U009. Subj: SOLE SOURCE JUSTIFICATION MEMORANDUM FOR UAS PILOT AND SUPPORT BPA 1. Identification of the agency and the contracting activity, and specific identification of the document as a �Sole Source Justification.� This is a sole source justification. Contracting activity is NSWC-PCD, Code 024, 110 Vernon Ave., Panama City, FL, 32407. 2. Nature and/or description of the action being approved. This action will award a firm fixed price Blanket Purchase Agreement to Red Six Solutions, LLC, 3 Vineberry Ct. Severna Park, MD 21146-1918 for the items described in Section 3. 3. A description of the supplies or services required to meet the agency�s needs (including the estimated value). The Contractor shall provide one (1) Functional Expert, one (1) Senior Unmanned Aerial Systems (UAS) Pilot, and one (1) UAS Pilot to support upcoming UAS detection tests. The Contractor shall support test planning and test events in Miami, FL and/or Los Angeles, CA and shall provide the associated flight logs resulting from testing. This procurement will be for one (1) Base Year with one (1) Option Year if the Government requires additional testing. This acquisition will be conducted using simplified acquisition procedures with a total estimated value greater than $25,000 but not exceeding the simplified acquisition threshold of $250,000.00. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This purchase will be funded with Department of Homeland Security Other Government funding. 4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor�s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. The sponsor for this effort, the Transportation Security Administration (TSA) is working in coordination with the Department of Homeland Security (DHS) to utilize Red Six Solutions for site and vulnerability assessments which will be utilized to develop an application for a Certificate of Authorization (COA) from the Federal Aviation Administration (FAA). As Red Six Solutions develops the COA application and receives the authorization, they will have inherent awareness that other vendors will not have. Another vendor would need to perform a site and vulnerability assessments in order to obtain the relevant knowledge to provide the service requested, and their pilots and UAS would need to be listed in the COA application package. This makes the utilization of Red Six Solutions advantageous, saving the Government both time and money. As such, the government does not expect significant savings through competition and it is more advantageous to the Government to award on a sole source basis to the Red Six, LLC for the services listed in Section 3. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government�s needs. 6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. For the reasons specified in paragraph 4 above, Red Six, LLC is the only source that can meet the Government�s needs. This requirement will be be synopsized in the government point of entry sam.gov because it is estimated greater than $25,000.00. 7. Any other facts supporting the justification. None. 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 above, Red Six, LLC is the only source that can meet this requirement. (c)� Delayed Opening, Early Dismissal and Closure of Government Facilities.� When a Government facility has a delayed opening, is closed or Federal employees are dismissed early (due to severe weather, security threat, security exercise, or a facility related problem) that prevents personnel from working, onsite contractor personnel regularly assigned to work at that facility shall follow the same reporting and/or departure directions given to Government personnel. The contractor shall not direct charge to the contract for such time off, but shall follow parent company policies regarding taking leave (administrative or other). Non-essential contractor personnel, who are not required to remain at or report to the facility, shall follow their parent company policy regarding whether they should go/stay home or report to another company facility. Subsequent to an early dismissal, delayed opening, or during periods of inclement weather, onsite contractors should monitor the OPM website as well as radio and television announcements before departing for work to determine if the facility is closed or operating on a delayed arrival basis. (d) When Federal employees are excused from work due to a holiday or a special event (that is unrelated to severe weather, a security threat, or a facility related problem), on site contractors shall continue working established work hours or take leave in accordance with parent company policy. Those contractor employees who take leave shall not direct charge the non-working hours to the contract.� Contractors are responsible for predetermining and disclosing their charging practices for early dismissal, delayed openings, or closings in accordance with the FAR, applicable cost accounting standards, and the company�s established policy and procedures. Contractors shall follow their disclosed charging practices during the contract period of performance, and shall not follow any verbal directions to the contrary. These official files may contain information that is considered a trade secret, proprietary, business sensitive or otherwise protected pursuant to law or regulation, hereinafter referred to as �protected information�. File management services consist of any of the following: secretarial or clerical support; data entry; document reproduction, scanning, imaging, or destruction; operation, management, or maintenance of paper-based or electronic mail rooms, file rooms, or libraries; and supervision in connection with functions listed herein. (b)��The cognizant Contracting Officer will ensure that any NAVSEA contract under which these file management services are acquired will contain a requirement that (1) �The support contractor not disclose any information; (2) �Individual employees are to be instructed by the support contractor regarding the sensitivity of the official contract files; (3)��The support contractor performing these services be barred from providing any other supplies and/or services, or competing to do so, to NAVSEA for the period of performance of its contract and for an additional three years thereafter unless otherwise provided by law or regulation; and, (4)��In addition to any other rights the offeror may have, it is a third party beneficiary who has the right of direct action against the support contractor, or any person to whom the support contractor has released or disclosed Protected Information, for the unauthorized duplication, release, or disclosure of such Protected Information. (c)��Submission of a proposal will be considered as consent to NAVSEA's permitting access to any information, irrespective of restrictive markings or the nature of the information submitted, by its file management support contractor for the limited purpose of executing its file support contract responsibilities. (d)��NAVSEA may, without further notice, enter into contracts with other contractors for these services. Offerors are free to enter into separate non-disclosure agreements with the file support contractor. Contact the Procuring Contracting Officer for contractor specifics.
