Description
Synopsis: Notice of Intent to Award a Sole-Source Contract Announcement Number: NFFKPR00-22-03430 Project Title: Acoustic Analysis in support of Marine Mammal Protection Act The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Office of Protected Resources (OPR), intends to negotiate on a sole source basis, under the statutory authority of FAR 13.106-1(b)(1)(i), with JASCO Applied Sciences (USA) Inc. for technical assistance for acoustic analysis in support of Marine Mammal Protection Act (MMPA) and the Endangered Species Act (ESA) compliance. Specifically, NMFS requires technical, analytical, and modeling support to assist in the development and completion of revised and corrected Incidental Take Regulations (ITRs) for geophysical and geological survey activities in the Gulf of Mexico. Additionally, there is a broader need for technical expertise to train staff in sound characteristics, propagation and the assessment of acoustic impacts on marine animals. Last, there is a continuing need for acoustic modeling and analysis related to sound source characteristics and propagation to aid in the impact analyses NMFS conducts under MMPA and ESA. The North American Industry Classification Code (NAICS) for this acquisition is 541690, Other Scientific and Technical Consulting Services, with a business size standard of $16.5 million. Sole Source Justification JASCO conducted the initial modeling underlying the impact assessment for the Draft Programmatic Environmental Impact Statement (PEIS) and MMPA Incidental Take Authorizations (ITRs) as well as the supplementary modeling to correct the ITRs, and are in possession and full understanding of the results. The calculations and modeling modifications contemplated are an extension of those initial efforts utilizing the agreed-upon and extensively discussed methodologies and parameters. Additionally, to support their assessment and modeling work, JASCO developed (based on extensive collaboration with NMFS) a proprietary calculator that only they currently own and can operate. They understand and have effectively executed the previous modeling using the parameters that we discussed and are in the singular position of being able to easily and effectively conduct this extension of that original modeling. It would take significant money and staff time to reconstruct the previous modeling with any other company and would be entirely inefficient and a poor use of resources. Additionally, their development of the modeling and methodologies that support the Gulf of Mexico (GOM) impact analysis, following extensive coordination with NMFS to ensure their understanding of our MMPA and ESA compliance needs, makes them uniquely qualified to provide both technical and training support for core MMPA/ESA needs. Switching to a different calculation system would render the existing system unusable. The investments made to procure, configure and train personnel on the current system would not be recovered by producing another manufacturer�s product. Compatibility and consistency is essential to meet mission requirements. The long-standing need is critical to the continued data reliability and quality that support NOAA�s NMFS/OPR. Further, government resources would need to be allocated for the testing, approval, acceptance, and interfacing of a new system with an existing system. JASCO does not authorize resellers or distributors of their proprietary information. Special Notice This special notice is not a solicitation for competitive quotes, nor will one be posted on Contract Opportunities. However, if an interested party believes that it is capable of meeting the requirements and be in compliance with the above justification, they may submit substantiating documentation in writing within the open period of this notice. A determination by the Government not to conduct a competitive procurement, based upon response to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice. All responsible sources may submit a Capability Statement in accordance with the solicitation, which shall be considered by the agency if received on or before 11:00 AM EDT on August 23, 2022. The Capability Statement must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
