- THIS IS A 5 YEAR FIRM FIXED PRICE REQUIREMENTS CONTRACT THEREFORE, PRICES CANNOT BE ADJUSTED. PRICES ON THE CONTRACT WILL BE IN EFFECT REGARDLESS OF MARKET FLUCTUATIONS OR OTHER CHANGES. GENERAL This is a five-year Requirements contract. Contractors shall provide containers specified below and all personnel, equipment, tools, transportation, and an y other items necessary to perform delivery of empty Department of Transportation (DOT) approved containers to Red River Army Depot (RRAD). All containers delivered under this contract must be new containers that conform to DOT specifications found in the 49 Code of Federal Regulations (CFR). Containers must be performance-oriented and must meet the testing requirements of 49 CFR 178. All containers must be embossed with a UN symbol that indicates that the container was manufactured according to the United Nations Recommendations. This system is in use in the United States and is generally accepted by all modes of transportation worldwide. The containers must also be marked with the Packaging Identification Codes that will identify the type of container and materials of construction and the Performance Standards code that identifies the performance standard and all other applicable markings required for DOT compliance. CERTIFICATION AND ACCREDITATION REQUIREMENTS Contractor shall comply with all applicable Federal, State, and local Environmental Laws and Regulations and Policies. Contractor shall meet all license and certification requirements required by Federal, State and Local environmental laws and regulations necessary to adhere to the specifications of this contract. All open head metal 55-gallon containers must at least have the packaging Identification Code of 400 to ensure maximum strength and integrity to hold up to 882 pounds of solid waste that may also be classified as a hazardous waste per 40 CFR. All metal containers must have a liner unless special requested upon order. All open head 55 gallon metal containers must have a minimum of 2 � inches of flat space between the top ring (Crease) and the second ring (Crease) due to the typ2ae of latching drum lids currently used on open top containers. The current latching lids will not fit properly if there is not enough flat space between the creases to properly close and seal required under current Environmental Protection Agency (EPA) regulations. RRAD prefers that 55 gallon drums are the double bung style if available. Only ordered specific closed or open if double bung is unavailable. On all fiber lamp drums one end must be glued. All drums will have metal lid closures. Polyurethane drums will have tapered walls to ensure safer handling.� Metal drums will have approximately 0.5 in recessed walls between the swedges to allow drum grips a better grasp on the container. The 20 Gallon container shall have handles that extend from the top of the container to aid in transport. All containers must have proper closure instructions and shall be provided by the contractor with the first delivery for each Contract Line Item Number (CLIN) for each ordering period (CDRL A001). This is required by DOT Regulations 49 CFR 178.2(c) and 178.601 (b).INSPECTION AND ACCEPTANCE �INSPECTION AND ACCEPTANCE Contractor shall be responsible for all equipment and personnel for the delivery, off-=loading and placement of all containers. Waste containers shall be delivered to RRAD Environmental Division Building 479, within twenty four hours from notification by an authorized RRAD Government-appointed Representative. The Government Representative shall be responsible for the inspection and acceptance of the containers to ensure compliance with the terms of the contract. Contractor shall provide a standard commercial warranty for drums/containers. PROJECT MANAGER Contractor shall provide a designated representative and/or Project Manager who shall be responsible for the performance of the work under this contract. The name and phone number of this person shall be designated in writing to the Contracting Office, RRAD. The designated representative shall be available in person or by telephone during duty hours as indicated in paragraph 5.A and 5.B to discuss any problem areas, oversight of all work performance and interaction with designated Government personnel. The project Manager must have full authority to act for the contractor on all matters pertaining to the performance of this contract.� WORK SCHEDULE & WORK HOURS Federal holidays that fall on a Sunday, the following Monday will be observed, When a holiday falls on a Friday or Saturday the proceeding Thursday is observed as that holiday. Normal business work hours at RRAD will be Monday thru Thursday 6:15 a.m. to 4:45 p.m. Central Standard Time. All work scheduled will be performed during normal business hours.
