DESCRIPTION: INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute of Neurological Disorders and Stroke (NINDS) and the Animal Health Care Section (AHCS) intends to negotiate on a sole source basis with CAYUSE, LLC for purchase of maintenance and support services for the Vivarium Management Application suite. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 511210 � Software Publishers with a Size Standard of $41.5 million. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2022-07 dated Aug 10, 2022. DESCRIPTION OF REQUIREMENT � The Animal Health Care Section (AHCS) of the National Institute of Neurological Disorders and Stroke (NINDS) is tasked with veterinary care, management and oversight of the Building 35/35A SAF. The Building 35/35A SAF currently houses approximately 17,000 mouse and rat cages, consisting primarily of mice.� The rodents housed in these cages are used by numerous NIH Institutes and Centers (ICs) to carry out their research missions. The NINDS AHCS has an immediate need to purchase maintenance and support services for the vivarium management application suite that was purchased in 2018 from NTM Consulting Services. This application suite provides a system of integrated modules to support the management and reporting of key vivarium services that are essential for the efficient management of animal study protocols, animal cage inventory, and animal ordering for NINDS and the nine institutes and centers that share animal holding space. The AHCS is seeking a comprehensive maintenance and support agreement for the following five (5) modules that together provide vivarium resource management under the Cayuse Resource Management platform: 1.�������� IACUC Protocol Management 2.�������� Training Tracking 3.�������� Animal Inventory Management 4.�������� Animal Procurement 5.�������� Resource Scheduling This project will last 1 year with 4 additional option years. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION During market research, it was found that Cayuse, LLC is the only vendor that can provide maintenance and support for the current ACHS system due to Cayuse�s proprietary software applications. Cayuse Resource Management platform is a proprietary software whose application platform requires annual maintenance and support agreement by the developers to remain serviceable by the vendor, remain compliant with NIH/NINDS security protocol, and to keep the tools up to date to allow greater user efficiency. The software has been custom configured to the specifications and operational requirements of the NINDS/AHCS and was originally supplied by NTM Consulting Services. NTM Consulting Services was acquired by Cayuse, LLC, including their proprietary software, making Cayuse the only vendor that can provide the needed support and maintenance. With these facts in mind, it was found that Cayuse, LLC, would be the only vendor that can meet the requirements of this acquisition due to the proprietary nature of the software. The intended source is: Cayuse, LLC. 121 SW Salmon St. Suite 900 Portland, Oregon 97204-2919 CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Unique Entity Identifier ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by the closing date and time of this announcement and must reference the solicitation number, NIMH-22-011279-NOI.
