NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT FOR LABORATORY ANALYSIS SERVICES PROJECT NAME: Laboratory Analysis Services AGENCY Name: Department of Labor, Office of the Senior Procurement Executive (OSPE), Office of Acquisition Services (OAS) ANNOUNCEMENT NUMBER: 1645-OTS-22-NAT-0000 The Department of Labor (DOL), Office of the Senior Procurement Executive (OSPE), Office of Acquisition Services (OAS), hereby submits a notice of intent to award a sole-source award to International Asbestos Testing Laboratory (IATL) located at 9000 Commerce Parkway, Suite B, Mount Laurel, NJ 08054, to provide laboratory analysis services. These services are for samples that are collected by Mine Safety & Health Administration (MSHA) inspectors and other MSHA personnel at mining operations throughout the United States and its territories. Since 2012 MSHA Technical Support has been sending mineral fiber air and bulk samples collected by MSHA inspectors to International Asbestos Testing Laboratory (IATL) for asbestos fiber analyses.� IATL was awarded the contract two consecutive times through open market competition.� In both instances IATL was able to meet the required needs of the Agency and offer services at a cost that was less than half of that offered by the next closest bidder.� During the timeframe of nearly 10 years IATL has provided exceptional service and support to the Agency.� The reduced pricing for the analyses has saved the Agency a significant amount of money over that span.� IATL has provided technical advice on more than one occasion concerning positive asbestos sampling results and possible litigation.� Their analytical results for MSHA samples have agreed with the confirmatory analyses of the same samples provided by the OSHA Salt Lake laboratory.� The laboratory director for IATL is well-known in the industry for his contributions in the field of asbestos testing and analysis.� He serves on multiple committees including ASTM and AIHA.� The vendor has provided complimentary presentations to MSHA Technical Support and field employees on the latest methods for asbestos sampling and analysis at no extra cost. If this requirement was to go out for open market competition, the outcome would prove the same as the two previous that IATL would be able to meet the needs of the Agency and statement of work at a cost significantly less than any other competitor that proved capable.� IATL provides the Agency a reputable service, with added support of those services that strengthen MSHA�s enforcement capabilities for asbestos exposure monitoring.� The procurement will be issued under the authority of Federal Acquisition Regulation (FAR) FAR 13.106-1(b)(1)(i) Soliciting from a single source. �The North American Industry Classification System (NAICS) code is 541380. Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not delay the evaluation and analysis services. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice. This is NOT a request for quotes or proposals. A solicitation is not available.
