- NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Eastern Acquisition Division (EAD) and the Office of Marine and Aviation Operation (OMAO), using the procedures set forth in Federal Acquisition Regulation (FAR) subpart 13.5 and part 12, intends to negotiate on a sole source basis with SpaceX for a firm-fixed price contract for STARLINK satellite telecommunications. The statutory authority is 41 U.S.C. 1901, using Simplified Acquisition Procedures up to $7.5M as authorized by FAR 13.500(a) and implemented by FAR 13.501(a). The NOAA fleet internet service is currently supported by traditional Geostationary Equatorial Orbit (GEO) or Medium Earth Orbit (MEO) satellite networks. NOAA has determined that a one (1) year sea trial of Low Earth Orbit (LEO) satellite telecommunications is necessary. This requirement will test emerging commercial off the shelf (COTS) LEO technology for efficiency and efficacy. NOAA requires COTS terminals and all associated accessories necessary to install a LEO telecommunications system on 10 ships for a period of 12 months.� The anticipated period of performance is from October 1, 2022 through September 30, 2023 with an anticipated award date on or around September 14, 2022. The North American Industry Classification System Code (NAICS) is 517410, Satellite Communications. This notice does not constitute a solicitation, Request for Proposal (RFP), Request for Quotation (RFQ), or an Invitation for Bid (IFB) and it does not restrict the Government in any way regarding its ultimate acquisition approach. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements. Capability statements and related materials must be e-mailed to Contract Specialist Bridget Cofo at bridget.cofo@noaa.gov by 4:00 PM Eastern on August 31, 2022.
