Description Notice of Intent to Sole Source THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE QUOTES. U.S. Customs and Border Protection, U.S. Border Patrol, Law Enforcement Operations Division (LEOD), Intelligence Division intends to award a firm fixed price sole source base year contract (period of performance 09/15/2022 through 09/14/2023) under the authority of FAR 6.302-1 only one responsible source to: Pen-Link, LTD. 5936 Vandervoort DR Lincoln, Nebraska 68516 The North American Industry Classification System (NAICS) code for this requirement is 511210, Software Publishers. The object of this sole source award is to have continued access to the PenLink PLX system analytical tool to collect and catalogue massive amounts of communication data. PenLink PLX, Ltd. is the sole source provider of all PenLink software products in the United States. They do not use agents, dealers, or distributors. PenLink PLX software can only be purchased directly from PenLink, Ltd. The LEOD has used licenses from PenLink PLX for over a year and has designated a separate computer only for PenLink PLX purposes. Analysis of communications data in support of multiple law enforcement investigations is ongoing and would be irreparably interrupted by a switch to a new product/platform. This synopsis does not constitute a solicitation; however, if any interested party believes they can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities must be submitted in writing and must contain clear and convincing evidence that competition of this requirement would be advantageous to the Government. If parties choose to respond, any cost associated with preparation and submission of data or any other cost incurred in response to this announcement are the sole responsibility of the respondent and will not be reimbursed by the Government.
