SHAW RESERVOIR CHANGE OF WATER RIGHTS Expert Services This announcement constitutes the only notice. This is not a request for quotes. A determination not to compete is solely within the discretion of the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Responses must be received no later than 13 September 2022, by sending an e-mail to kspetter@blm.gov; however, any technical data received will be for the sole purpose of market research for future requirements. Under Simplified Acquisition Procedures (SAP), the Bureau of Land Management Colorado State Office intends to issue a sole source, firm-fixed contract line modification to 140L1722P0016 with the Brown and Caldwell, UEI: KMZMQL18BLF1 for up to $25,000 for additional work out of scope in addition to the already awarded line. Additional hours of expert witness services are required pursuant to the approved statement of work for the contract. This is what the BLM estimates will be required to process a typical water right change case. If statements of opposition reveal more issues to resolve than originally anticipated, additional requisitions may be submitted to cover additional expert witness. AUTHORITY: 13.501 Special documentation requirements. 13.106(b) Soliciting from a single source. Determinations not to compete this proposed procurement were made because: BLM must file change applications immediately to make use of the acquired water rights. As part of the water rights change process, the Colorado Water Court System and the Colorado Water Division of Water Resource require that any change application by supported by a comprehensive engineering analysis of the historical diversions and consumptive use associated with the water rights. The change process also requires that the consulting engineer be made available to meet with parties who file protests to the change application, to conduct additional engineering analysis requested by the State of Colorado, and to provide verbal and written testimony in administrative and court hearings. The change process does not allow consulting engineers who work in support of change applications to rely exclusively upon analysis and reports previously authored by other parties. If they attempt to do so, the State will not qualify or admit them as an expert witness. This procedure is used because the consulting engineer is required to be an expert witness, and they must have intimate knowledge of the techniques, assumptions and data used in the historical water rights analysis.
