West Palm Beach VA Medical Center intends to award a single Firm Fixed Price (FFP) contract for One FMS HVAC Supervisor and Four FMS HVAC Technicians. There will four One Year Option Periods in addition to the Base Period of Performance. This procurement is set aside for Service-Disabled Veteran s Owned Business (SDVOSB), Set-Aside and all eligible quoters are encouraged to submit quotes. Scope of Work (SOW): Insufficient HVAC FTEE, Joint Commission findings, deferred utility equipment repairs and deferred preventative maintenance of utility equipment at the WPB VA Medical Center contributed to an emergency service contract need to support the FMS HVAC Section for one (1) full year plus four (4) options years. The facility is estimating a need of one (1) Contractor Supervisor and four (4) employees daily Monday through Friday 2pm to 10:30pm excluding government holidays to cover all the requirements. A full year of work is 40 hours per week two hundred and forty-nine (249) days. Contract to be executed at the West Palm Beach VA Medical Center located at U.S. Department of Veterans Affairs 7305 North Military Trail West Palm Beach, FL 33410 2. Performance Work Statement (PWS) Deliverables: The work shall be owner directed assignments via Contractor Superintendent, but shall not be limited to the following (not necessarily in the order indicated) Contractor shall provide all management, supervision, and labor necessary to perform HVAC facility repairs and preventative maintenance directed by the COR throughout the site. Physical removal and re-installation of failed/defective components Installs, recognizes the cause of faulty equipment, and repairs, modifies and relocates equipment on special-purpose refrigeration and air conditioning units and systems that are frequently modified to provide specific and critical conditions in laboratories, operating suites, and other special purpose facilities. Contractor must perform all services using EPA certified technicians who specialize in HVAC, refrigeration and electronic system maintenance and repair service The work requires Air Conditioning & Refrigeration (AC&R) journeyman level skills and knowledge to make repairs to a variety of AC&R systems throughout the Medical Center. Required to have experience in pneumatic and electronic controls used in the AC&R industry. Modifies and balances various elements of systems that are designed to meet a wide variety of extreme and critical conditions. Modifies, alters, or substitutes components and elements of the system to meet specific pressure-temperature characteristics. Works with HVAC Section Supervisor personnel while planning and modifying a system to meet specific conditions and accomplishes repairs and modifications to meet conditions required. Knowledge of building automation system and the ability to trouble shoot electronic systems controlling AC&R systems. 3. Time of Completion: This service contractor will perform work starting when supplied parts is received from the VA on site completing all necessary work as required, if contractors need to adjust / extend the work hours/days, a request will be submitted and must be approved by the CO/COR before starting work. 4. Workmanship: All workmanship must be first class, or of the best quality All equipment mechanics personnel directly engaged in the work to be accomplished under the contract shall possess, prior to their employment in a journeyman mechanic s capacity on this contract. In accordance with Section 608 of the Clean Air Act, this position requires a current Environmental Protection Agency (EPA) approved Universal Certification. The Contractor shall require all employees, including supervisors, to wear distinctive uniform clothing for ready identification, and assure that every employee is in uniform no later than the time specified by the COR, or otherwise no later than 10 working days from the date an employee first enters on duty. The uniform shall have the Contractor s name, easily identifiable, affixed thereon in a permanent manner such as a badge or monograms. The Contractor shall adhere to all OSHA, EPA, NFPA Life Safety Codes, and all other regulatory requirements. In performance of this contract, the Contractor shall follow VAMC safety policy and standard for safe work practices and take such safety precautions as the Safety Officer or designee may determine to be reasonably necessary to protect the lives and health of occupants of the building. The Contractor shall comply with VAMC smoking policy, which designates all interior space as non-smoking areas. Patient, employee, visitors, and contractor personnel safety shall be always maintained. The contractor is responsible for the occupation safety and health of his/her employees. The Contractor shall comply with all applicable OSHA safety and health standards. The Contractor shall replace all safety guards, equipment, devices, etc. removed to service or repair the HVAC utility equipment immediately after completion of work or when leaving the job unattended. The Contractor is responsible to identify, provide and maintain all personal protective equipment required to perform the duties outlined in the contract. In addition, the contractor is responsible for identifying and providing all applicable safety programs (i.e., lockout/tag out, confined space entry, universal precautions, etc.) required to perform the work. Training on required safety programs and the proper use of PPE s shall be provided, and documentation maintained by the contractor. The Contractor shall obtain a Hot Work Permit from the COR whenever soldering, welding, using a cutting torch, or other open flame, spark, or heat producing equipment. The contractor is required to follow ALL requirements outlined for the issuance of the Hot Work Permit. Contractor is responsible for the supervision of all their employees while on government property. It is the Contractor s responsibility to assure compliance with the scope of work and requirements referenced in this contract. Provisions provided in the scope of work are not intended to relieve the Contractor of this responsibility. Safety program/procedures are required to be followed by the contractor s personnel in the performance of their duties and when such procedures are required. Contractor shall submit a written report to the VAMC within five work (5) days of any incident of a major malfunction, accident or injury involving a utility equipment. The report shall state the cause, what and when repairs and tests were or are to be made to correct the cause of the incident. The Contractor shall provide the COR with pertinent emergency telephone numbers, to summon assistance in case an emergency develops. At least one of the emergency telephone numbers shall be manned twenty-four (24) hours per day. This information shall be provided in writing to the COR, prior to the contract start date. The Contractor shall prohibit his employees form disturbing papers on desks, opening desk drawers or cabinets, or using telephones or office equipment provided for official Medical Center use. Contractor shall require his employees to comply with the instructions pertaining to conduct and other regulations called to the Contractor s attention by the CO/COR, Federal Protective Officers, Inspectors, etc. The Contractor shall immediately notify the COR of the existence of the development of any defects in, or repairs required to the utility equipment which the contractor considers he is not responsible for under the terms of the contract. The contacting officer also reserves the right to solicit the services of other contractors to make utility equipment s repairs. The Contractor shall require his employees to comply with all VA rules and regulations pertaining to the conduct of his employees while on station. Particular attention is drawn to the fact that all VISN 8 VAMC s are NO SMOKING facilities. Smoking is not permitted in any building (including Penthouses and elevator pits). Contractor Quality Control / Inspection / Supervision: The Job Site Supervision will: Inspect the quality of work performed. The Contractor shall arrange for satisfactory supervision of the contract work. The Contractor or his on-site supervisors shall be always available when the contract work is in progress to receive schedule of task, notices, reports, or request from the Contracting Officer or the COR. Certify the completed work for payment and other purposes. A follow up inspection to be conducted by the VA upon notification of substantial repair by the contractor. 6. Project completion: The repair site shall be restored to a condition equal to that existing prior to the commencement of work. Haul away & dispose of all debris and waste to an approved VA disposal dumpster on site. Thoroughly clean up the work area at the end of each day s work, and at completion of the repair. Leave the premises clean and free of waste, scrap, used equipment, or other material intentionally or incidentally delivered to the site by Contractor or Contractor s personnel. 9. Physical Requirements: Heaviest weight handled by the contractor unassisted will normally be 50 pounds, and with assistance 100 pounds or more. Uses lifting devices or obtains assistance in moving heavy items. Moderate lifting 15-44 pounds, Light lifting under 15 pounds, heavy carrying 45 pounds and over, moderate carrying 15-44 pounds, light carrying under 15 pounds, straight pulling, pulling hand over hand, pushing, reaching above shoulder, use of fingers, both hands required, both legs required, Works from ladders, scaffolding and/or platforms where systems are in hard-to-reach places, requiring contractor to work in close quarters or in cramped positions. Work requires hand-eye coordination and manual dexterity to manipulate tools when assembling units and replacing defective components, coordination for reading and setting gauges, checking for refrigerant leaks, and adjusting controls, and color discrimination to recognize color code. Work frequently requires stooping, stretching, bending, and kneeling for long periods. ability to distinguish basic colors and shades of colors, depth perception, working alone, working around machinery with moving parts. Working Conditions: Works indoors and outdoors, on elevated structures, and in cramped areas. Subject to discomfort from face masks and/or other protective devices when there is a possibility of exposure to toxic refrigerants, noxious gases, fumes, or acids. Contractor is exposed to the dangers of moving equipment, energized electric circuits, sharp metal edges, and toxic fumes while performing the duties of the contracted tasks. Exposure to electrical conductors, moving objects, sharp edges, etc., may occur along with danger to cuts, burns, and respiratory ailments. Typical safety equipment required by the trade includes safety shoes, safety glasses and hard hats. 10. Additional Considerations: The Facility is estimating a need of one (1) supervisor and four (4) employees daily Monday through Friday 2pm to 10:30pm with 30 minutes lunch excluding government holidays to cover all the above requirements. The VA will provide log sheets and materials need to perform repairs. The VA will provide the equipment and materials need to measure temperature and relative humidity and will also provide the initial training on use of the measuring equipment. Contractor will be required to pay their employees prevailing wages as required by federal labor laws. Individuals who have been selected to be a contractor for six months of continued service will be contacted by the Contracting Officer Representative (COR) and complete electronic VA Form 0711. In addition, the Contracting Officer Representative or designee will work with the Security Information Center (SIC) if the position request includes a background investigation. The contractor will complete section IV electronically in the PIV office along with PIV staff. The contractor will later be contacted for verification and badge issuance. An independent contractor shall be considered a subcontractor. An otherwise eligible firm further agrees to the following: (1) Services. In the case of a contract for services (except construction), it will not pay more than 50% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs. (2) Supplies or products. (i) In the case of a contract for supplies or products (other than from a nonmanufacturer of such supplies), it will not pay more than 50% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs. (ii) In the case of a contract for supplies from a nonmanufacturer, it will supply the product of a domestic small business manufacturer or processor, unless a waiver as described in 13 CFR 121.406(b)(5) is granted. (3) General construction. In the case of a contract for general construction, it will not pay more than 85% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs. (4) Special trade contractors. In the case of a contract for special trade contractors, it will not pay more than 75% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs. (5) Subcontracting. Any work that a VIP-listed SDVOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, cost of materials is excluded and not considered to be subcontracted. For mixed contracts and additional limitations, refer to 13 CFR 125.6. (e) Joint ventures. A joint venture may be considered an SDVOSB if the joint venture is listed in VIP and complies with the requirements in 13 CFR 125.18(b), provided that any reference therein to service-disabled veteran-owned small business concern or SDVO SBC, is to be construed to mean a VIP-listed SDVOSB. A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (d) of this clause will be performed by the aggregate of the joint venture participants. (f) Precedence. For any inconsistencies between the requirements of the SBA program for service-disabled veteran-owned small business concerns and the VA Veterans First Contracting Program, as defined in VAAR subpart 819.70 and this clause, the VA Veterans First Contracting Program requirements have precedence. (End of Clause) C.4 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING MONITORING AND COMPLIANCE (JUL 2018) (DEVIATION) (a) This solicitation includes VAAR 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2019) (DEVIATION) (b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records, or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement. (c) All support contractors conducting this review on behalf of VA will be required to sign an Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. (d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.
