- NOTICE OF INTENT TO AWARD A SOLE SOURCE This is a Notice of Intent published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This Notice of Intent is for a proposed sole source, under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) � Soliciting from a single source. The Environmental Protection Agency (EPA) intends to award this requirement under the authority of FAR 6.302-1(a)(2), �Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.� The primary North American Classification System Code (NAICS) is 811310 � Commercial and Industrial Machinery and Equipment (except Automotive and Electronic) Repair and Maintenance and the Small Business Size Standard is $11.0M. The Product Service Code (PSC) is 6640 Regulation of Agricultural Marketing and Commodities. This Notice of Intent is not a request for quotes/proposals. This is not a solicitation or request for offers. No solicitation package is available and telephone requests will not be honored. The EPA intends to award a sole source Maintenance Agreement (Base+ 2 Option Years) for the Thermo Q Exactive HF Mass Spectrometer and Liquid Chromatograph (LC) component. This procurement will be accomplished using FAR Part 13 ordering procedures. Interested parties may identify their interest and capability to respond to this requirement within 15 calendar days of the publication of this notice (no later than 27 October 2022). Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this proposed purchase order based upon response to this notice is solely within the discretion of the Government.
