- To protect Controlled Unclassified Information (CUI) included within solicitations and market surveys across Naval Information Warfare Systems Command (NAVWAR), contractors (including team members and subcontractors) will be required to sign and submit the attached Non-Disclosure Agreement (NDA) to the Contracting Officer for non-SeaPort-NxG contracting opportunities prior to being provided access to solicitation/market survey documents with CUI. Only individuals within a particular company will be given access to Controlled Technical Information (CTI). NAVWAR, at its discretion, may limit the number of individuals approved for access to the information. Non-SeaPort-NxG contracting opportunities include those issued under the NAVWAR e-Commerce portal and portals/websites that external agencies (e.g., General Services Administration, Defense Information Systems Agency) use to solicit NAVWAR contract actions. To clarify, the attached NDA is not required for SeaPort-NxG contracting opportunities, as the SeaPort-NxG portal already requires users to agree to rules of behavior prior to entering the portal, including a requirement to protect CUI. Furthermore, if a solicitation or market survey includes unclassified technical data disclosing militarily critical technology with military or space application under the control of, or in the possession of, the U.S. Department of Defense (DOD) or the Canadian Department of National Defense (DND) (e.g., CTI), then contractors will be required to submit the attached current, valid DD Form 2345 (Military Critical Technical Data Agreements) to the Contracting Officer prior to being granted access to solicitation/market survey documents with this type of information. Upon receipt of the applicable documents above, NAVWAR will securely transmit the applicable CUI/CTI included within the solicitation/market survey to the individuals who signed the NDA. To minimize delays in the procurement process, contractors should familiarize themselves with (1) the documents above, (2) the frequently asked questions (FAQs) regarding the DD Form 2345 cited below, and (3) follow the process of obtaining current, valid DD Form 2345s as soon as possible in order to be eligible to access unclassified technical data disclosing militarily critical technology with military or space application (e.g., CTI) included within NAVWAR�s solicitation/market survey.
