- N0016423RJQ13 � SOLE SOURCE � ELECTRO-OPTICAL SIGHT (EOS) � FSC - 5855 � NAICS 334511 Issue Date: 8 December 2022 � Closing Date: 23 December 2023 � 5:00PM Time Eastern ITEM DESCRIPTION- Naval Surface Warfare Center (NSWC) Crane has a requirement for the procurement of MK 48 Mod 2 Electro-Optical Sight (EOS) (Part Number 116061), Lower Replaceable Units (LRUs), installation kits (Part Numbers 116598 and 116599), spare consumable components, repair efforts, and Interface Design Documentation in support of the MK 38 MOD 4 Machine Gun System (MGS). The proposed contract action is for the supplies and services for which the Government intends to solicit and negotiate a two year Firm-Fixed Price Indefinite-Delivery, Indefinite Quantity contract with one source, MSI-DEFENCE SYSTEMS US, LLC (MSI-DS) (CAGE: 7XRR8), located in Rock Hill, South Carolina, under the authority of FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The requirement is being solicited on a sole source basis due to lack of sufficient technical data, duplication of costs that are not expected to be recovered through competition, and unacceptable delays in fulfilling the agency requirement through any other source. The contract is anticipated to be awarded in 4th Quarter of Fiscal Year 2023 and to be FOB Destination with a nine (9) month delivery After Receipt of Order (ARO). MSI-DS is the sole owner of the proprietary data rights for the EOS and is the Original Equipment Manufacturer (OEM). MSI-DS possesses the knowledge and expertise to build and design the EOS test equipment and spare parts, and therefore, is the only source to provide necessary EOS repairs. A determination by the Government not to compete this proposed contract based upon responses to this solicitation is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of re-evaluating the justification for sole source or limitation of sources and making a determination to change the acquisition strategy to a competitive procurement. The Solicitation and amendments for this sole source action will not be posted to sam.gov and are available only from the POC identified below. Request for Proposal (RFP) will not be made available through https://www.sam.gov. All responsible sources may submit a bid, proposal, or quotation which shall be considered by the agency.� The RFP will be provided to MSI-DS through electronic mail. The proposed non-competitive contract action is anticipated to be awarded through FAR Part 15, contracting by negotiations. Contractors must be properly registered in the System for Award Management (SAM).
