SINGLE SOURCE JUSTIFICATION Title of Procurement Procurement Support for the ARSR-4 TCS Low Ambient (PN 004-001-0001, IFS# 016458061) and High (PN 0020-001-0001, IFS# 016458058) Ambient Cooling Towers PR No.: AC-22-10942-LCSS Program Office and Point of Contact Radar Product Division, FAALC, AMJ-L900 Project Management, Radar Technical Program Support Branch, AJW-L910, Electronic Engineer, Radar Technical Program Support Branch, AJW-L910, Nature of Procurement Action The Federal Aviation Administration (FAA) proposes to procure from RAE Corp two (2) ARSR4 Transmitter Cooling System (TCS) Low Ambient Towers, PN 004-001-0001 and two (2) High Ambient Towers, PN 0020-001-0001 to support serviceable stock levels at the Depot for the ARSR4 Radar System. This procurement is for replenishment of the TCS system overall stock level using funding provided by 2nd Level Engineering (SLE) under service order agreement number AJW-22-001-24279. Description of Supplies/Services There is a total of forty-three (43) supported ARSR4 systems in the NAS and one (1) Academy system. Approximately thirty-one (31) of the current forty-four (44) ARSR4 sites are equip with the TCS cooling system. The Depot is response for support of all thirty-one sites and any future added TCS sites. The OEM manufacture of the TCS system is RAE Corp.� The TCS is a custom designed manufactured and supplied to the FAA by RAE Corp. RAE Corp is the original manufacturer of the TCS system making them the proprietary designer and manufacturer of the TCS system and all its associated components. In addition, the FAA does not control all the spec/drawings to allow for open competition. Authority The FAA proposes to procure the requirements on a single source basis as contemplated by AMS 3.2.2.4 in that RAE Corp is the only source capable of meeting the FAA�s requirements due to part availability and obsolescence concerns. The TCS system towers are necessary and important to support the FAA�s mission. RAE Corp is the only known source currently capable of supporting the FAA needs.� Rationale Supporting Use of a Single Source The ambient towers are wholly manufactured by RAE Corp as part of the TCS system. The rights to all proprietary information necessary to conduct manufacture and test of these assets are owned by RAE Corp. Due to the uniqueness of the system design and quantity of parts needed as such, RAE Corp is the only qualified and authorized source capable of meeting the FAA requirement for serviceable assets needed for ARSR4 systems. It is in the best interest of the FAA to use a single source to replenish the stock level because the subject requirement is only available from one source. Market Analysis A market survey was posted on the SAM.gov website (6973GH-23-MR-Tower) on December 14, 2022, soliciting other companies capable of manufacturing the Low Ambient Towers.� No responses were received.� As no inquiries were received because of the posting, it is assumed that no company took exception to the single source solicitation, which supports that RAE Corp is the only source capable of supplying these towers to the FAA. Encouraging competition is not appropriate for this system since there is proprietary intellectual property involved.� Historical data shows that previous purchases and repairs of the High and Low Ambient Towers were performed by RAE Corp. A PO (DTFAAC-15-P-06682) was issued on 9/17/2015, PO (DTFAAC-16-00676, and PO (DTFAAC-17-P-06152 was issued on 8/9/2017. In addition, there was a PO (AC-22-03630 issued by 2nd Level Engineering.
