- Description
- This is a notice of proposed contract action in accordance with FAR 5.201. The Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Satellite and Information Acquisition Division (SIAD) intends to award a sole source contract to Ball Aerospace and Technology Corporation (BATC). �The Government anticipates awarding a contract that will provide five (5) years of engineering and anomaly support to NOAA�s Office of Satellite and Product Operations (OSPO) to adequately operate the SNPP and NOAA-20 satellites that uses Ball Aerospace and Technology Corporation (BATC)�s proprietary BCP-2000 heritage spacecraft bus. The engineering and anomaly support includes but is not limited to required operational maintenance support and anomaly resolution support for the spacecraft, spacecraft to instrument interfaces, simulator maintenance and support, and flight software maintenance and associated updates, and spacecraft to ground interfaces. BATC is the incumbent contractor for this work. A Justification for Other than Full and Open Competition (JOFOC) is being prepared to support award of a sole source contract to BATC in accordance with FAR 6.3, which cites the authority at 41 U.S.C. 3304(a)(1) as implemented by FAR Subpart 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. BATC is the only qualified source because: (1) it is the only vendor with sufficient access to BATC owned proprietary information and simulation/testing equipment necessary to support the BCP-2000 heritage spacecraft bus; and 2) it us the only vendor with sufficient experience and expertise to continue to provide this support to the SNPP and NOAA-20 satellites. � This requirement has been determined to be commercial services in nature because BCP-2000 is a commercial product and the intended contract will be for services in support of BCP-2000.�� This notice is not a request for competitive quotes or proposals. However, vendors that have questions regarding the sole source nature of the requirement or vendors that believe they can fully provide the required services may submit substantiating written documentation to Ms. Jane Bu, Contract Specialist, and Ms. Elizabeth Abraham, Contracting Officer, within seven (7) calendar days of this notice. Information received will be considered solely for the purpose of determining whether, and how, to proceed with the planned sole source acquisition for these requirements. A determination by the Government not to conduct a competitive procurement based on the responses to this notice is solely within the discretion of the Government.
