14 A: General Information Title of Project: Autopsies During COVID-19 Pandemic Introduction: This Statement of Work (SOW) defines the requirements for autopsy services to be provided to the Atlanta & Dublin Veterans Affairs Medical Centers during COVID-19 pandemic. General Background: VHA Directive 2011-019 addresses the autopsy as a critical component of quality management and states that the autopsy is an invaluable component of high-quality health care. Occasionally, autopsies are requested or deemed necessary by this facility. Autopsy services will be contracted out. 4. Scope of Work: This outlines the services required by the Atlanta & Dublin Veterans Affairs Medical Centers for autopsy services. Decedents Affairs Office will coordinate and arrange medical records and consent information required for performance of autopsy. Delivery and pick-up to and from the performing laboratory will be coordinated through the contractor such that no decedent storage outside of Atlanta VA Healthcare System facility is necessary or permitted. VAHCS will notify vendor of decedent COVID status and charges will apply based COVID status (see IGCE for cost) Performing pathology will add one Toxicology to autopsy request as necessary to complete and determine cause of death (see IGCE for cost) Vendor will transport decedent to and from VA facility to autopsy lab (see IGCE for cost) If request to transport decedent to funeral home is made by Decedents Affairs personnel, an additional transport charge will be approved (see IGCE for cost) Vendor will be responsible for death certificate (see IGCE for cost) All autopsies will be performed, or directly supervised, by a pathologist who is board certified in anatomic pathology. The contractor shall provide all resources necessary to accomplish the deliverables described in this statement of work (SOW), except as may otherwise be specified. A documented preliminary report of the gross pathologic findings will be produced and submitted by secure mail or fax to the Service Line Chief of Pathology and laboratory Medicine Services (PLMS), COR or designee at Atlanta VAHCS within two working days. The final report will be submitted to the Service Line Chief PLMS, COR or designee within thirty days except when toxicology is required to complete autopsy. 5. Period of Performance: The contractor shall perform full autopsy examinations as described in the statement of work. The period of performance of this service contract is November 21, 2022, to November 20, 2023. 6. Type of Contract: Firm Fixed Price (billable per decedent) B. Contract Award Meeting The contractor shall not commence performance on the tasks in this SOW until the contracting officer (CO) has conducted a kickoff meeting or advised the contractor of a verbal approval for work to start which indicates that a kickoff meeting is waived. C. General Requirements The contractor will complete the autopsy and provide a provisional anatomic diagnosis (PAD) within 2 working days and a final anatomic diagnosis (FAD) within 30 working days. The FAD will be extended by 5 weeks when toxicology is added. The reports will be submitted to the Service Line Chief, COR, or designee at the ATLVAMC by secure mail or fax in an appropriate format. The contractor shall ensure the confidentiality of all patient information and shall be held liable in the event of a breach of confidentiality. The contractor is subject to all federal and state statutes, rules and regulation regarding patient privacy. Schedule for Deliverables The Decedent Affairs office will coordinate and arrange delivery of the body with the laboratory and the vendor after all authorization and consent documents related to the release of the body along with the medical records has been completed/obtained The vendor shall transport the decedents as directed by Atlanta VAHCS facility personnel and in accordance with the terms specified in the SOW The contractor shall deliver the documented preliminary report of the gross pathologic diagnoses within two days and the final report within thirty days to the Chief Pathologists, COR, or designee. The vendor s pathologist shall determine need for toxicology to be added to an autopsy request The FAD will be extended by 5 weeks when toxicology is added. If for any reason any deliverable cannot be delivered within the scheduled time frame, the contractor is required to explain why in writing to the CO, including a firm commitment of when the work shall be completed. This notice to the CO shall cite the reasons for the delay, and the impact on the overall project. The CO will then review the facts and issue a response, in accordance with applicable regulations. E. Changes to Statement of Work Any changes to this SOW shall be documented via a bilateral modification. Costs incurred by the contractor through the actions of parties other than the CO shall be borne by the contractor. F. Reporting Requirements The contractor shall provide preliminary as well as final report for each autopsy report completed to the PLMS pathologist in charge, COR, or designee. The contract will provide progress report for autopsies not finalized within thirty days The contractor may only invoice after preliminary autopsy report has been provided to Atlanta VAHCS. Invoice payment shall be within 30 days of receipt of invoice Interest or late payment charges shall not apply if invoice is paid with 30 days G. Government Responsibilities The ATL VAHCS shall provide pertinent medical information required to complete the autopsy within the constraints of existing privacy rules and regulations. H. Contractor Experience Requirements Only a qualified licensed pathologist, board certified in anatomic pathology, can provide a final written diagnosis for gross and microscopic post-mortem examination findings. The contractor shall identify, by name, the key management and technical personnel who will work under this task order at the time the work is being negotiated. If a key person becomes unavailable to complete the autopsy, the proposed Substitutions of key personnel shall be made only as approved directed by the Contracting Officer and the COR. The contractor shall submit a resume of qualifications to the COR and all other direct employees proposed for the project. All Contractor employees will be approved by the COR prior to bringing on duty. Any time from date of award to the end of the contract, non-key Contractor personnel are no longer available, the Atlanta VAHCS reserves the right to review the qualifications of the proposed replacement personnel and to reject individuals who do not meet the qualifications to perform the service. The contractor must inform the VHA COR and or Decedents Affairs when personnel are removed from the contract for any reason. I. Confidentiality and Nondisclosure It is agreed that: 1. The preliminary and final deliverables, and all associated working papers, application source code, and other material deemed relevant by VA which have been generated by the contractor in the performance of this task order, are the exclusive property of the U.S. Government and shall be submitted to the CO at the conclusion of the task order. 2. No information shall be released by the contractor. Any request for information relating to this task order, presented to the contractor, shall be submitted to the CO for response. 3. Press releases, marketing material, or any other printed or electronic documentation related to this project, shall not be publicized without the written approval of the CO. Contractor Personnel Security Requirements No contractor employees will be granted access to the Department of Veterans Affairs computer systems. In the performance of official duties, the contractor's personnel may have access to printed sensitive information, which must be protected under the provisions of the Privacy Act of 1974, HIPAA and other applicable Federal laws and regulations. The employee is responsible for (1) protecting that information from unauthorized release or from loss, alternation, or unauthorized deletion. PATIENT SENSITIVE DATA: The Contractor must adhere to the provisions of Public Law 104-191, Health Insurance Portability and Accountability Act (HIPAA) of 1996 and the National Standards to Protect the Privacy and Security of Protected Health Information (PHI). As required by HIPAA, the Department of Health and Human Services (HHS) has promulgated rules governing the security and use and disclosure of protected health information by covered entities, including the Department of Veterans Affairs (VA) and the Department of Defense (DoD). The VA has recognized that Diagnostic Facilities are Health Care Providers, and the PHI is being disclosed and/or used for treatment of an individual, and are entities that do not require a Business Associates Agreement (BAA) with their contractors as long as they are conducting health care on behalf of the VA. The contractor is required to have background investigation initiated on its team members that will handle VA patient PHI. The Contractor is considered a Government Provider for purposes of the Privacy Act of 1974. The treatment and administrative patient records created by, or provided to, the Contractor under this agreement is covered by the VA system of records entitled Patient Medical Records-VA (24VA136). Medical records shall be secure, complete, legible, accurate, accessible, organized and maintained in a format that facilitates retrieval of information. Information from VA medical records requested by the patient or any other third party shall be referred to Health Information Services (HIMS) at Atlanta or Dublin VA Medical Center in accordance with Privacy Act of 1974, Title 38 of United States Code (U.S.C.) (U.S.C 5701, 5705 and 7332), as well as other Federal law, embodied elsewhere in the U.S. Code that bear directly on the privacy of personal data. The Contractor is restricted from making disclosures of Government records, or information contained in such records, to which it may have access, except to the extent that explicit disclosure authority from the Government has been received. The Contractor is subject to the same penalties and liabilities for unauthorized disclosures of such records as the Government. In the event of a privacy incident, the contractor is responsible for notifying the contracting officer or the Contracting officer representative within one hour of the discovering the incident. VHA Supplemental Contract Requirements for Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors Contractor employees who work in or travel to VHA locations must comply with the following: Documentation requirements: If fully vaccinated, shall show proof of vaccination. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination. If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor s order or an FDA approved over-the-counter test. Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel. Documentation will not be collected by the VA; contractors shall, always, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.  Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, always, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.  Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.
