- INTRODUCTION PURSUANT TO FAR Subpart 5.2-Synopses of Proposed Contract Actions, THIS IS A PRE-SOLICITATION NOTICE OF A PROPOSED CONTRACT TO ACTION. THIS IS A PRE-SOLICITATION NON-COMPETITIVE NOTICE OF INTENT TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), National Institute of Mental Health (NIMH) intends to solicit by a request for quotation from Bruker Biospin Corporation for award on or around March 1, 2023. The purpose of this purchase order will be to provide the National Institute of Mental Health (NIMH) with a Maintenance and Service Agreement for a NMR Spectrometer. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811210� 1/31/23, 9:44 AM SAM.gov https://sam.gov/opp/b0d09c3cd44463a6fad499e172333ab0/view 3/6 Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $20,500,000.00 � REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses of the Federal Acquisition Regulation (FAR) in effect through the Federal Acquisition Circular FAC 2019-01/ 01-22-2019. STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. FAR Subpart 13.106-1(b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). DESCRIPTION OF REQUIREMENT: Purpose and Objectives The purpose of this order is to procure a maintenance and service agreement for a NMR Spectrometer. Chemists routinely use this instrument for the characterization of organic molecules synthesized in the PRSS laboratory. The NMR spectrometer is manufactured and installed by Bruker Biospin Corporation, Billerica, MA. Once a year, Bruker's engineer performs a major preventive-maintenance (PM) service on the NMR spectrometer. Whenever there is a hardware issue, the company dispatches its engineer to the site for troubleshooting and fixing the problem. The PM also includes regular upgrading of the NMR software. Background Information and Objective: The PET Radiopharmaceutical Sciences Section of Molecular Imaging Branch (PRSS/MIB/NIMH) is equipped with a 400 MHz NMR spectrometer.� The instrument�s model is Avance III HD 400 Nanobay with system ID no. 10246033.� This research instrument is manufactured by Bruker BioSpin Corp.� The NMR spectrometer enables characterization of organic molecules by providing 1D spectra for proton, carbon, fluorine, boron and selenium, and 2D spectra for some of these nuclides. The instrument is used by 15 chemists in the laboratory. The NMR should be operational with minimal downtime for ready accessibility and lab�s productivity. The NMR Spectrometer is currently covered by the manufacturer�s maintenance service agreement under contract no. 75N95020P00108 and will expire on Feb 28, 2023. Independently and not as an agent of the Government, the Contractor shall furnish all the necessary services, qualified personnel, material, equipment, and facilities, not otherwise provided by the Government as needed to perform the�Statement of Work below: The contractor shall be responsible for the maintenance of all the components of the NMR spectrometer: 1) Nanobay Console; 2) Magnet; 3) Temperature Control Unit, BCUII; and 4) Probe, PA BBO 400S1 BBF-H-D-05 Z.� A certified engineer shall perform once every year a major PM service on the NMR system.� In addition, the contractor shall respond to service calls and provide expertise in fixing the problem. The contractor shall send its certified engineer to the laboratory when a repair is needed. If necessary, the contractor shall replace the parts at no additional cost. Specific Requirements: A qualified engineer from the company (contractor) shall perform an annual PM service on the NMR spectrometer. �The PM task involves: 1) testing of console�s electronic boards; 2) inspection or testing of magnet�s vibration damper, airflow, liquid helium level (calibration), NMR probe and the cooling unit; 3) replacement of air filters (console and cooler); and 4) repair the components or correct any problems, if needed. �In the next step, the engineer shall perform 90� pulse calibration for proton, carbon and fluorine nuclides. The engineer shall shim the magnet and create a line-shape until an acceptable line-width is attained for the chloroform peak.� Subsequently, the engineer shall check the sensitivity by measuring signal-to-noise ratio from the ethyl benzene spectrum.�� After completion of the PM services, the contractor shall prepare a report and submit it to the laboratory supervisor. The contractor shall troubleshoot and repair all components of the NMR spectrometer.� The service contract also covers the cost of repair and replacement of any of the parts involved. If NMR probe needs to be repaired or serviced, the laboratory shall ship it to the designated workshop. The contractor shall ship the probe back to the laboratory at no additional cost.� Additionally, the contractor shall provide expertise in resolving any software or hardware problems that may be encountered during routine operation of the instrument.� Services shall be performed by an authorized OEM service provider using genuine OEM parts. This service contract is required in order to maintain this research equipment and prevent costly repairs. CLOSING STATEMENT: THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.
