- INTRODUCTION PURSUANT TO FAR Subpart 5.2-Synopses of Proposed Contract Actions, THIS IS A PRE-SOLICITATION NOTICE OF A PROPOSED CONTRACT TO ACTION. THIS IS A PRE-SOLICITATION NON-COMPETITIVE NOTICE OF INTENT TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), National Institute of Mental Health (NIMH) intends to solicit by a request for quotation from Bruker Biospin Corporation for award on or around March 1, 2023. The purpose of this purchase order will be to provide the National Institute of Mental Health (NIMH) with a Maintenance and Service Agreement for a 11.7 Tesla (T) MRI/MRS scanner. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811210� 1/31/23, 9:44 AM SAM.gov https://sam.gov/opp/b0d09c3cd44463a6fad499e172333ab0/view 3/6 Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $20,500,000.00 � REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses of the Federal Acquisition Regulation (FAR) in effect through the Federal Acquisition Circular FAC 2019-01/ 01-22-2019. STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. FAR Subpart 13.106-1(b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). DESCRIPTION OF REQUIREMENT: Purpose and Objectives The purpose of this order is to procure a maintenance and service agreement for a 11.7 Tesla (T) MRI/MRS scanner. The�11.7 Tesla (T) MRI/MRS scanner�is manufactured and installed by Bruker Biospin Corporation, Billerica, MA. The Section on Magnetic Resonance Spectroscopy (MRS) and the MRS Core Facility own and operate an 11.7 T MRI/MRS scanner.� As this instrument is used often for a variety of research needs, the user serviceable parts need periodic replacement, and the overall calibration and function of the instrument must be continuously assessed.� To maintain the equipment in proper working condition, the government needs an OEM service contract to provide periodic and on-demand maintenance service for the 11.7 Tesla animal scanner. Background Information and Objective: The Section on Magnetic Resonance Spectroscopy (MRS) and the MRS Core Facility own and operate an 11.7 T magnetic resonance imaging/spectroscopy (MRI/MRS) animal scanner manufactured by Bruker. The scanner has been mainly used to obtain MRI and MRS from animal brain to study neural metabolism of animal brain. The scanner needs an annual service contract with Bruker. Independently and not as an agent of the Government, the Contractor shall furnish all the necessary services, qualified personnel, material, equipment, and facilities, not otherwise provided by the Government as needed to perform the�Statement of Work below: (a) Obtain updated software packages (b) Obtain technical supports for applications from their application team (c) When the scanner has some problems, we can obtain service supports from their service team including � � � (i) obtaining consult and diagnostic from their phone service �hot line or web-based service � � � (ii) obtaining replacement units for broken hardware components or devices � � � (iii) arranging field engineer to come to NIH for onsite diagnostic and repair as needed Specific Requirements: Performance of the above tasks will be performed by a mechanical and / or system engineer who has the requisite specialized experience with Magnetic Resonance Spectrometers.� We estimate the total number of labor hours over the period of performance to be 100 hours. Services shall be performed by an authorized OEM service provider using genuine OEM parts. This service contract is required in order to maintain this research equipment and prevent costly repairs. CLOSING STATEMENT: THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by February 15, 2023 at 5:00 PM, Eastern Standard Time, and reference number NIH_NIDA_NIMH23-001023.
