- THIS SOURCES SOUGHT NOTICE IS ISSUED SOLELY FOR INFORMATIONAL AND PLANNING PURPOSES AND DOES NOT CONSTITUTE A SOLICITATION.�No formal solicitation documents exist at this present time. Responses to this Sources Sought notice will be utilized by the Government to make appropriate acquisition decisions. After review of the responses to this Sources Sought notice, a solicitation announcement may be published via SAM.gov | Contract Opportunities. Background: The American Battle Monuments Commission (ABMC), established by Congress in 1923, is an agency of the executive branch of the federal government. The ABMC administers, operates and maintains 26 overseas commemorative cemeteries and 32 memorials located in 17 foreign countries. The ABMC honors the service, achievements and sacrifice of U.S. Armed Forces by creating and maintaining memorial sites, offering commemorative services, and facilitating the education of their legacy to future generations.� ABMC is staffed by approximately 500 full-time civilian employees, including about 90 U.S. citizens and 410 civilian foreign national employees. The Inspector General Act of 1978 establishes three different frameworks for the conduct of audit activities within federal entities, largely keyed to the size and budget of those entities. The three frameworks are: Congressionally established Offices of Inspector General for the largest entities (5 U.S.C. Appx Section 2); Agency established Inspector Generals for ""Designated Federal Entities"" (5 U.S.C. Appx Section 8G(a)(2)); and Agency audit responsibilities remain with agency leadership for ""Federal Entities"" (5 U.S.C. Appx Section 8G(a)(l)). The American Battle Monuments Commission is classified in the third ""Federal Entity"" category and accordingly does not have an agency inspector general.� Nonetheless, ABMC is committed to improving its performance and recognizes that the quality of its performance depends significantly on public confidence and support, as well as internal support and motivation on the part of all ABMC employees. Objective: �ABMC is seeking a qualified professional to provide as needed investigative services on employee disclosures and complaints that would otherwise be made to an inspector general.�� Scope of Work:� Investigate complaints from agency employees concerning: Possible violation of law, rules or regulations; Mismanagement; Gross waste of funds; Abuse of authority; Substantial and specific danger to public health and safety; and Suspected violations of conflict of interest laws and other government ethics laws and regulations. Tasked work may include reviewing agency records, interviewing agency staff and other individuals, and preparing an investigation report and findings, including a supporting record. The Scope of Work does not include complaints concerning matters subject to or covered by established formal employee appeal procedures, such as� Prohibited discrimination complaints under Title 29 of the U.S. Code (discrimination on the basis of race, color, religion, sex, national origin, age, disability, genetic information, or retaliation) from employees, former employees or applicants for employment. Such complaints are adjudicated under the Equal Employment Opportunity (EEO) complaint program. Any matter appealable to the Merit Systems Protection Board (MSPB), including but not limited to adverse actions and reductions-in-force. Matters subject to the agency's administrative grievance procedures. Uniformed Services Employment and Reemployment Rights Act appeals. Such complaints are adjudicated by the Department of Labor. Complaints of prohibited personnel practices. Such complaints are handled by the Office of Special Counsel. Position classification appeals. Such appeals are adjudicated by the Office of Personnel Management. Complaints of waste, fraud or abuse of authority at another federal agency. Responses must be received no later than March 8, 2023 by 1700 EDT. Response to this notice is not an offer and cannot be accepted by the Government to form a binding contract.
