- Naval� Facilities Command (NAVFAC) Mid-Atlantic, Public Works Department (PWD) Earle, New Jersey invites you to participate in a new 8(a) Basic Ordering Agreement (BOA) program for providing facilities construction and repair at the Naval Weapons Station Earle (NWS Earle) in both Colts Neck and Leonardo, New Jersey.� In response to the continuing adverse effects of COVID-19, SBA has temporarily imposed a moratorium on the requirement that a Program Participant must have a bona fide place of business in the applicable location determined by SBA in order to be awarded an 8(a) contract for construction, 13 C.F.R. � 124.501(k).� Your company may be eligible as a possible participant; see eligibility requirements below. Please note that a BOA is not a contract but rather an agreement of understanding between the PWD Earle and the 8(a) Business Development Participant that contains the terms, conditions and contract clauses, and other administrative procedures that would apply to any orders issued under the BOA.� The duration of the BOA will be for a maximum period of five years, from 01 May 2023 through 31 August 2027, or until either the BOA participant is no longer eligible under the 8(a) Business Development Program or becomes other than small business for the NAICS codes assigned under the BOA. The current BOA expires on 31 August 2027. In order to be eligible for award of a task order under a BOA order solicitation, the contractor must be considered a small business pursuant to the NAICS code applicable to that solicitation.� The specific NAICS code assigned to a proposed order will be from NAICS Subsectors 236210 & 236220, 237110 through 237990 or 238110 through 238990.� The majority of task orders to be solicited under this BOA are expected to be in the $25,000 to $500,000 range; however individual task orders as large as $1,000,000 and up to $4,500,000 are possible.� As the need for work arises, BOA participants will be invited to compete on task order solicitations. �Most orders will be evaluated on a low price basis; however there may be times when a technical proposal may be required for evaluation.� There is no guaranteed minimum amount of work that will be ordered under the BOA.� The maximum cumulative amount that may be ordered under any one BOA is $5,000,000.� Each task order issued under this BOA shall constitute an individual contract.� To be considered �active� under the BOA, the firm must participate in at least one (1) competitive Request For Proposal (RFP) in a 12-month period. Inactive firms will become ineligible to receive RFPs and will not be in a position to be awarded a task order under the BOA. PWD Earle�s Contracting Office reserve the right to suspend any firm from competing that have received two (2) or more �Letter of Concern� under a single task order. In order to be eligible for the receipt of a BOA, you must: ���� (1)� Be certified as a SBA 8(a) Business Development Participant with a bona fide place of business anywhere within the United States. ���� (2)� Maintain an active registration in the System for Award Management (SAM) with no exclusions or active federal debts subject to offsets. ���� (3)� Have a Satisfactory or better past performance record verifiable in CPARS. ���� (4)� Have an 8(a) program exit date on or after 31 August 2027. (5)� Have the ability to obtain payment and performance bonds If your firm would like to participate in the BOA program, please respond to this notice by 21 April 2023 and; (1) Update your SAM Representations & Certifications (both FAR and DFARS), (2) Provide a letter from your regular Surety verifying the aggregate and single project bonding limit available to your firm, (3) Provide verification from the SBA servicing District office that you have a bona fide place of business within the district and (4) provide a capability statement showing past or current contracts under the required NAICs code.
