INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Office of Acquisition (OA) the National Center for Advancing Translational Sciences (NCATS), intends to negotiate and award a purchase order without providing for full and open competition (including brand-name) to Life Technologies Corporation 5781 Van Allen Way Carlsbad, CA 92008 for CellInsight CX5 System for the Antiviral Program for Pandemics. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 334516: Analytical Laboratory Instrument Manufacturing with a Size Standard of 1000. � REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2022-08 dated October 22, 2022. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: One inherent limitation of the response to the SARS-CoV2 pandemic was a readily apparent limitation of high-throughput screening capacity for biologic organisms requiring BSL3 level containment. This required the preparation of pre-spotted assay ready plates to be sent to contract research organization for screening, following their desired plate type, format, and screening in only their established assay. As such, NCATS was limited to screening SARS-CoV2 assay in 384-well format, instead of our normal 1536-well plate format, not only limiting the assay throughput but also necessitating re-tooling of compound libraries. This growing demand has led to the need for additional screening instrumentation not just for assay ready plates but to be used as a general laboratory instrument for assay development projects. To address this limitation, the National Center for Advancing Translational Sciences (NCATS) has newly established a Biosafety Level 3 (BSL3) Laboratory to support its ongoing SARS-CoV2 work. To facilitate screening, we request the purchase of a CellInsight CX5, which is a compact benchtop high-content screening platform, offering automated quantitative cell analysis. This high-containment biological laboratory is required due to the added safety infrastructure required for propagation and handling of SARS-CoV2, including increased air handling requirements and greater security, not currently available within the 9800-laboratory complex. Overall, this project will support ongoing work for small molecule and combination screening, in silico virtual screening, nanobody/antibody design and optimization that are part of NCATS�s ongoing work to support the pandemic response. In addition, we are performing in vitro assays to support efforts to characterize the response of variant SARS-CoV2 viruses to current vaccine and therapeutic interventions. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Unique Entity ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size.
