Description
Notice of Intent (NOI) The US Army Corps of Engineers, Omaha District (ERDC) intends to negotiate on a sole source basis (IAW FAR 6.302-1(a)(2)(iii)) with Conti Federal Services, Inc., 2045 Lincoln Hwy, Edison, New Jersey 08817-3334, a contract modification to contract W9128F21C0039 to renegotiate expired Contract Line Item Number (CLIN) 0003, which will include a reduction in the number of CCTV cameras from the initial contract from 18 each to 10 each and the addition of 29 intrusion detection system units, which were not included in the initial contract scope. Contract W9128F21C0039 is for the construction of 28,000 square foot Fighter Alert Shelter which will house four universal fighter aircraft to accommodate the mission of the Air National Guard at Truax Field, WI. The contract included base CLINs for the construction of the facility, as well has numerous optional CLINs, including those for integration of the electronic security system (ESS) into the facility. The contract was awarded to Conti Federal Services on July 19, 2021. The contract was awarded using full and open competition procedures. This is a notice of intent to industry that the Government intends to issue this out-of-scope, additional work modification directly to Conti under their current contract. Conti is currently directed by the contract to install all ESS supporting infrastructure. The contract outlines the requirements for such infrastructure but leaves the implementation up to the contractor�s own �means and methods�. Conti is already thoroughly familiar with the site and facility requirements and will be developing their ESS infrastructure installation plan to avoid conflict with other MEP systems and include locations and sizes of ESS conduit pathways and junctions to support the ESS cabling and equipment that is not currently awarded. If the Government were to competitively solicit this scope of work, the current prime contractor would have superior knowledge and offer vastly less risk to the Government in performing the installation in comparison to any other potential offerors. Further, the costs associated with a new project�s general conditions and mobilization would be prohibitively expensive and place additional cost and liability on the Government. This acquisition is being conducted under FAR 6.302-1(a)(2)(iii), Only One Responsible Source. The NAICS code assigned to this contract is 236220, Commercial and Institutional Building Construction. This notice of intent is not a request for competitive proposals and no solicitation document exists for this requirement. However, parties interested in responding to this notice shall submit technical data, including price, sufficient to determine capability in providing the same or similar items. All capability statements received by the closing date of the publication of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Capability statements shall be submitted by e-mail only as a Microsoft Office Word, Microsoft Office Excel, or Adobe PDF attachment to michele.a.renkema@usace.army.mil and amanda.e.eaton@usace.army.mil. Statements are due by 12:00 PM Central Time, April 21, 2023. No phone calls will be accepted.
