Description
The Ranger View road realignment project qualifies for a single source award due to the unusual and compelling urgency of the situation. Since the previous contractor was terminated for default FAR 49.402-6 authorizes the�contracting officer�to use any terms and�acquisition�method deemed appropriate for the repurchase.� The urgency is directly related to the termination for default.� The termination has resulted in the need for additional assessments of the site by engineering and new specs and drawings to be created.� Because of this additional work needed to re-procure, it has drastically reduced the time available to seek competition for this requirement. This road is the only access to the Spotted Bear Ranger Station, two permitted guest resorts, multiple trailheads that access the Bob Marshall Wilderness Complex and the Silvertip rental cabin.� If access is restricted it will result in significant consequences to the Ranger District�s program of work.� Sixty-three employees will be unable to access their Summer duty station and their residences while the road is closed.� A lack of access for fire suppression could result in catastrophic consequences.� The two guest lodges would lose income if access was closed.� At least four permitted outfitters and guides would lose income due to lack of access.� The Spotted Bear Timber Sale and the GAOA Spotted Bear & Meadow Creek Road Resurfacing contract will be impacted by a road closure after May 15.� This could result in claims against the government for delay of contract. The East Side Reservoir Road is closed to traffic until May 15 every year.� While Spotted Bear may be accessed from the West Side Road, conditions usually prevent much activity before May 15.� The District is normally staffed and operational within a few days of this date.� Therefore, we would like to have the road open by May 15.� To meet this deadline, the Contractor needs to get started on the work by April 1 at the latest.� A sole source contract is the only way to meet these timeframes. I have determined, in accordance with FAR 13.106-1(b) that the circumstances of this contract action deem only a single source is available for the required services.
