- NOTICE OF INTENT TO SOLE SOURCE This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source contract and is not a request for competitive quotes/proposals. The statutory authority for this sole source procurement is prescribed by FAR 13.501(a). The National Institutes of Health, The NEI Office The National Eye Institute requires a consolidated instrument service agreement covering preventative maintenance, repair of critical components and upgrade of critical software elements for multiple sophisticated microscope systems used by NEI researchers in the conduct of basic, clinical and translational research. The National Eye Institute-NIH conducts basic, clinical and translational research to identify the cellular basis of inherited and acquired eye diseases and develops therapies for treating these blinding disorders to preserve or restore vision in patients. To carry out this mission, the scientist and clinicians conducting research at the NEI require access to state-of-the-art microscopes and imaging systems. These microscopes and imaging systems are among the most technologically-complex instruments in the National Eye Institute and are also among the most heavily used by research scientists. These systems rely on patented technology and specialized components to operate properly. Factory-trained service engineers are the only personnel with the expertise and� tools (service dongles etc)� required to properly diagnose malfunctions when they occur. The original equipment manufacturer is often the only source of replacement parts for these complex instruments. The National Eye Institute operates 5 instruments manufactured by Carl Zeiss Microscopy LLC (White Plains, NY). These instruments are critical to NEI research efforts and require Premium service coverage to ensure that these systems will receive proper preventative maintenance and prompt and expert repair when they malfunction. These systems include the Zeiss EVO, Zeiss LSM780 confocal, Zeiss LSM 880 Airy confocal, Zeiss LSM 980/Axio Observer 7, Zeiss LSM 700 confocal and Zeiss AxioScan Z1. Previously, some of these systems were covered by annual service agreements obtained through third parties rather than Carl Zeiss Microscopy LLC. The services delivered by these third party entities were unacceptable for the following reasons: 1) the third party service did not cover software upgrades 2) �repairs to computer systems 3) replacement of critical elements like lasers, 4) timely repair and return to service for critical systems. These deficiencies resulted in reduced instrument performance and diminished scientific productivity.� The National Institutes of Health, National Eye Institute intends to award a sole source, fixed priced purchase order to Carl Zeiss to provide Consolidated annual Instrument service agreement providing �Protect Premium� level coverage for critical microscope systems operated by the National Eye Institute. The period of performance is to begin following contract award date. The purpose of this requirement is to assure that critical microscope systems operated by the National Eye Institute received annual preventative maintenance, upgrade of software controlling instrument operation and most critically, prompt and expert diagnosis and repair of malfunctioning microscope systems, including computers, �by factory trained Carl Zeiss Microscopy service personal with access to replacement parts authorized by the original equipment manufacturer, Carl Zeiss Microscopy. � Systems covered under this Premium level coverage will include the following: Zeiss EVO (000000-2024-654) Zeiss LSM780 confocal (2504000554) Zeiss LSM 880 Airy confocal (2802000296) Zeiss LSM 980/Axio Observer 7 (2871000139) Zeiss LSM 700 confocal (2601000344) Zeiss AxioScan Z1. (4631000372) One preventative maintenance inspection per agreement year. Labor, travel charges and covered replacement parts. Carl Zeiss Microscopy LLC� is an industry leader in the design and manufacture of laser-based confocal microscope systems and has pioneered the development and implementation of a number of ground breaking microscope technologies. Confocal microscopes manufactured by Carl Zeiss Microscopy rely on patented technology and specialized components to operate properly. Factory-trained Zeiss service engineers are the only personnel with the expertise and� tools (service dongles etc)� required to properly diagnose malfunctions when they occur. The original equipment manufacturer is often the only source of replacement parts for these complex instruments. All responsible sources may submit a capability statement demonstrating the ability to provide the requested services and/or products which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Interested vendors must respond to this notice on or before April 28, 2023 at 1:00 pm Eastern Time by sending an email to holleyv@od.nih.gov. .
