INTRODUCTION PURSUANT TO FAR Subpart 5.2�Synopses of Proposed Contract Actions, THIS IS A PRE-SOLICITATION NOTICE OF A PROPOSED CONTRACT TO ACTION. �� THIS IS A PRE-SOLICITATION NON-COMPETITIVE NOTICE OF INTENT TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME).� The National Institute on Drug Abuse (NIDA), Office of Acquisition (OA) at the National Insitutes of Health (NIH) on behalf of the National Center for Advancing Translational Sciences (NCATS) intends to negotiate and award a purchase order for annual renewal of licenses for software subscriptions to: PerkinElmer Informatics, Inc., 940 Winter Street, Waltham, MA 02451-1457. PerkinElmer is the publisher and only source for this commercial software due to exclusive licensing. NCATS utilizes this software to meet its needs for scientific data collection and management and has not identified any replacements or substitutes. Furthermore, this software has been utilized by NCATS for several years and supports extensive data requirements. The software is integrated into NCATS data ecosystem, and replacement would entail extensive configuration, data conversion, and user training. If the software renewals are not obtained, it will cause significant technical, schedule, and cost risk to mission-critical programs and data at NCATS. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 513210, Software Publishers, with a Size Standard of $47 million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses of the Federal acquisition Requlation (FAR) currently in effect at https://www.acquisition.gov/ STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures, Subpart 13.5 in accordance with 41 U.S.C. 1901. Simplified Acquisition Procedures. DESCRIPTION OF REQUIREMENT Project Description NCATS uses an array of PerkinElmer Informatics software for acquiring, analyzing, and managing data generated in NCATS laboratories. NCATS inventory of PerkinElmer software and software subscriptions currently includes: ����������� ChemDraw Professional ����������� ChemBioOffice Enterprise Suite ����������� Signals ImageArtist ����������� Signals Notebook ����������� Tibco Spotfire and associated components ����������� E-Notebook electronic laboratory notebook These software products have been acquired using individual acquisitions across several years. Renewal dates are scattered through the year, which creates complexity in tracking renewals and requires numerous purchase orders. Demand for additional licenses has risen as NCATS has grown, more scientists have come to rely on these products, and NCATS has created a standardized environment for data collection and management. In addition, the delivery model of these products has shifted from local installation to subscription-based and/or cloud-hosted delivery. The objective of this acquisition is to bring all current licenses onto a common renewal cycle, to renew current licenses for PerkinElmer Informatics software as those renewals come due, and add or remove licenses and seats. Purpose and Objectives The National Center for Advancing Translational Sciences (NCATS) requires annual renewal of licenses for software published by PerkinElmer Informatics as well as a streamlined arrangement to increase or decrease the number of licenses while maintaining a common renewal date for all PerkinElmer Informatics software licenses. Period of Performance Base period: ����������� May 31, 2023 � May 30, 2024 Option Period 1: ����� May 31, 2024 � May 30, 2025 Option Period 2: ����� May 31, 2025 � May 30, 2026 CLOSING STATEMENT This synopsis is not a request for competitive proposals.� However, interested parties may identify their interest and capability to respond to this notice.� Responses to this Notice must include clear and convincing evidence of the offeror�s capability of fulfilling the requirement. In addition the Unique Entity Identifier (UEI), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.� The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.�� All responses must be received by 05:00 PM EDT May 15, 2023.
