Award will be made to the offeror that provides the best value to the government, price and other factors considered: EVALUATION FACTORS FOR AWARD M02 - EVALUATION CRITERIA AND BASIS FOR AWARD The Government intends to award a contract resulting from this solicitation tothe responsible offeror whose proposal represents the best value after evaluation in accordance with the factors in the solicitation. The offeror's proposal shall be in the form prescribed by, and shall contain a response to each of the areas identified in the Section L solicitation provision entitled ""Submission of Proposals."" The evaluation of proposals will consider the offeror's non-price factor as well as the offeror's price factor. The non-price evaluation factors are compliance with the solicitation requirements, capacity/delivery, past performance and small business participation strategy. The evaluation of proposals will be as follows. A. Factors and Evaluation (1) Compliance with the Solicitation Requirements The Government will evaluate the offeror's proposal and determine whether it complies with the requirements of the solicitation. Please note, compliance with terms of the solicitation includes, but is not limited to: 1. Demonstrates Government Source Approval prior to award. 2. Demonstrating an unconditional offer to perform. A proposal that offers alternative terms or takes exceptions to a solicitation requirement will be considered ""technically unacceptable."" Compliance with solicitation requirements will be as either acceptable or unacceptable. The proposal will only be further evaluated if it is rated as acceptable. (2) Capacity/Delivery (3) Past Performance In determining the rating for the Past Performance evaluation factor, the Government will give greater consideration to the contracts or efforts which the Government considers most relevant to the RFP. Relevant past performance is performance under contracts or efforts (within the past three years) that is of similar scope, magnitude, and complexity to that which is described in the solicitation. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably on past performance. However, the proposal of an offeror with norelevant past performance history, while not ated favorably or unfavorably for past performance, may not represent the most advantageous proposal to the Government and thus, may be an unsuccessful proposal when compared to the proposals of other offerors. The offeror should provide the information requested above for past performance evaluation, or affirmatively state that it possesses no relevant directly related or similar past performance. If an offeror fails to provide any past performance information which is similar in scope, magnitude and complexity to that which is detailed in the RFP or fails to affirmatively state that it possesses no relevant directly related or similar past performance, the offer may not be awardable. The Government will consider the quality of offeror's past performance. This consideration is separate and distinct from the Contracting Officer's responsibility determination. The assessment of the offeror's past performance will be used as a means of evaluating the relative capability of the offeror and other competitors to successfully meet the requirements of the RFP. When an offeror is determined to have relevant past performance, the quality of its past performance will be evaluated; an offeror whose past performance demonstrates either a low expectation or no expectation that the offeror will be able to successfully perform the required effort will be considered ineligible for award. (4) Small Business Participation Strategy if applicable: The Government will evaluate the offeror's proposal to determine whether it has an acceptable small business participation strategy. The proposal will be rated as either acceptable or unacceptable. The proposal will only be further evaluated if it is rated acceptable. (5) Price Price is a secondary evaluation factor after delivery/past performance. Price will be evaluated on the basis of price analysis. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer and will be based on the evaluated price of all items listed. The Government reserves the right to award the contract to other than the lowest priced offeror. The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and non-price standpoint. However, the Government reserves the right to conduct discussions if later it is determined by the Contracting Officer to be necessary. The Government intends to make a single award. The Contracting Officer reserves the right to determine that the offeror's overall firm fixed price proposal represents an unacceptable level of risk, based on the information submitted by the offeror. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The Small Business Administration representative at NAVSUP WSS has reviewed this requirement and determined that a set-aside recommendation was not applicable for this procurement.
