- This is a special notice prepared in accordance with Federal Acquisition Regulations (FAR) 5.2 Synopses of Proposed Contract Actions The Bureau of Reclamation, Lower Colorado Basin (LCB) intends to negotiate and award a sole source firm-fixed price contract to GE Digital (GE) (Unique Entity ID C13HKCJPCEY3) 2623 Camino Ramon, Suite 500, San Ramon CA 94583-9130. The purpose of this acquisition is for the renewal of licenses for iFIX Software Package/Support for a base year and four option years. GE iFix software is the foundation for Reclamation's SCADA Systems and has been used to keep SCADA systems running. Purchase of this product(s) manufactured by GE ensures standardization, continuity, and compatibility with Reclamation's existing system/equipment. GE is the sole developer, licensor, and support service provider of iFix. This procurement is being conducted using commercial item procedures pursuant to FAR Part 12 and FAR Part 13.5, Simplified Procedures for Certain Commercial Products and Commercial Services. The NAICS code is 513210, Software Publishers. The size standard as defined by the U.S. Small Business Administration is $47.0M. This notice of intent is neither a formal solicitation nor a request for competitive proposals. No solicitation document is available and telephones requests will not be accepted. No award will be made based on unsolicited quotations or offers received in response to this notice. Any response to this notification must show clear, compelling evidence that competition will be advantageous to the Government. If no affirmative written responses are received by Monday, June 12, 2023, 4:00 P.M. (PST), an award will be made without further notice. The government anticipates the award of a firm-fixed price contract. A determination by the Government whether to compete this proposed requirement based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competition. Responses will not be returned. No entitlements to payment of direct or indirect costs charges to the Government will arise as a result of contractor submission of responses or the Government's use of such information or otherwise pay for the information provided in response. The Government reserves the right to use information provided by respondents for any purpose deemed necessary and legally appropriate. Any organization responding to this notice should ensure that its response is complete and sufficiently detailed to allow the Government to determine the organization's qualifications to perform the work; also, Respondents must be registered in the System for Award Management (SAM). Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted. After a review of the responses received, a pre-solicitation synopsis and solicitation may be published at SAM.GOV. However, responses to this notice will not be considered adequate responses to a solicitation.
