- The National Institute on Drug Abuse (NIDA) intends to award a sole source contract under the authority of Federal Acquisition Regulation (FAR) Subpart 8.405-6 Limiting sources. Specifically, FAR Subpart 8.405-6 (a)(1)(i)(B) � Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. This contract will be awarded to Chemaxon, LLC, 3511 Silverside Road, Suite 105, Wilmington, DE 19810, to provide support to NIDA�s Information Resources Management Branch (IRMB) and other users throughout the institute to support the use of the AIMS (ADTP (Addiction Treatment Drug Program) Information Management System) Application. NIDA anticipates the award of one firm fixed price-type contract for one 10-month and 12-day base period and four 12-month option periods. These software application licenses are proprietary to Chemaxon, LLC and have previously only been purchased through them. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 513210 with a Size Standard of $47.0 million. This acquisition is not set aside for small businesses. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The purpose of this acquisition is to support AIMS application. The AIMS application is used by NIDA staff to draw, modify, store, import, and export metadata and structure information of proprietary substances received from external entities. The received information often comes in non-industry formats that need to be transformed into a standard industry format.� The application is also used to verify that the chemical structure and metadata matches the information received from the submitter. The application is also used to search and compare both proprietary and non-proprietary substances for similarities or uniqueness across all chemical structures stored in the AIMS database.� Due to the nature of the proprietary substances, the AIMS system cannot publish the chemical structure and associated metadata for public consumption. This functionality has been implemented using JChem Oracle Cartridge, the chemical knowledge for which comes from the Marvin JS library.� Without these tools, the system would be unable to properly function and would be unnecessarily burdened by the inherent performance disadvantage of using Oracle�s Java Stored Procedures. NIDA requires license renewals for a 10-month and 12 day Base Period plus four (4) additional 12-month option periods. Without this contract in place the JChem Oracle Cartridge and Marvin JS Library licenses will lapse, and the AIMS application will lose its core functionality. PROJECT REQUIREMENTS: Broadly, the project requirements are for 100 user licenses for both the JChem Oracle Cartridge Software and the Marvin JS Library. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, Chemaxon, LLC is the only vendor in the marketplace that can provide the services required by NIDA. In accordance with FAR part 10, extensive market research was conducted to reach this determination. Specifically, contacts with knowledgeable individuals both in industry and Government, as well as reviews of available product literature, revealed no other sources. Finally, a review of the previous government acquisitions returned no results that meet all of the requirements. Therefore, only Chemaxon, LLC is capable of meeting the needs of this requirement. The intended source is: Chemaxon, LLC 3511 Silverside Road, Suite 105 Wilmington, DE 19810 CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include the following: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Unique Entity ID Number (UEI), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by the closing date and time of this announcement and must reference the solicitation number, 75N95023Q00335.
