Description
THIS IS A NOTICE OF INTENT TO SOLE SOURCE AND NOT A REQUEST FOR QUOTATION OR PROPOSAL. The U.S. Department of Commerce (DOC), Enterprise Services -Acquisition (ES-A), located in Washington, D.C., intends to negotiate on a sole-source basis to Axon Enterprise, Inc., 17800 N. 85th Street, Scottsdale, AZ 85255. This acquisition is being conducted under the authority of permitting other than full and open competition, 41 U.S.C.3304(e), as implemented by the Federal Acquisition Regulation (FAR) 13.501. This will be BPA with a 5-year ordering period. � The U.S. Department of Commerce (DOC), Bureau of Industry and Security (BIS), Office of Export Enforcement (OEE) is a federal law enforcement agency that conducts enforcement actions and investigations related to criminal and administrative violations of the Export Control Reform Act of 2018 (ECRA), the Export Administration Regulations (EAR) and other statutes and regulations. The acquisition of body-worn cameras are critical to OEE and other DOC law enforcement agencies in gaining compliance with Presidential Executive Order 14074, Executive Order on Advancing Effective, Accountable Policing and Criminal Justice Practices to Enhance Public Trust and Public Safety.� Further, when utilized within the specific guidelines and operational requirements set forth by OEE�s body-worn camera policy and standard operating procedures, body-worn cameras will capture and record interactions between OEE special agents and community members. Pursuant to DOC/BIS Information Security requirements, the SaaS (Software as a Service) solution for Digital Evidence Management System (DEMS) must be FedRAMP Authorized. Axon Evidence is the only software that includes FedRAMP Authorized solutions. FedRAMP Ready or FedRAMP In Process solutions do not satisfy the requirement. The Axon Evidence software is only available from its producer and manufacturer and not through dealers or distributors. � This is NOT a solicitation for quotations, quotation abstracts, a request for competitive quotations; or request for competitive proposals; however, all responses received within 15 days from the date of publication of this synopsis will be considered by the Government. Responses must clearly and thoroughly defend any claims or assertions that attempt to refute the Government�s claim. A determination by the Government not to compete this proposed action based upon responses to this notice is solely with the discretion of the Government. Information received will normally be considered for the purpose of determining whether to conduct a competitive procurement. Information received on this notice must eliminate the Government's concerns for required services. If no affirmative responses are received within 15 days of this notice to determine whether a qualified source is more advantageous to the Government, a contract will be issued to Axon Enterprise, Inc.
