- NOTICE OF INTENT TO SOLE SOURCE This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source contract, and is not a request for competitive quotes/proposals. The statutory authority for this sole source procurement is prescribed by FAR 13.501(a). The National Institutes of Health (NIH), the Division of Veterinary Resources (DVR) Primate Service intends to award a sole source, firm-fixed priced purchase order to Lab Products for new cages needed to match in functionality for the safety of the animals and the staff that use them.� The Primate Aluminum Squeeze Cage Assembly are manufactured and distributed solely by Lab Products for use with their existing equipment. ��Lab Products cannot guarantee compatibility with other manufacturers� equipment, therefore, these cages are used to restrain and transport primates for various medical procedures and transfer to other cages.� It is extremely important that new cages do not have any variations in construction or operation to prevent escape or injury to the animals.� Primates are moved from their home cages in these transport/restrainer cages to surgical or treatment rooms and at the same time the animals can be restrained with an equipped squeeze panel for the administration of drugs, anesthesia and other manipulations.� This can be very stressful to the animals.� The Lab Products transport/restrainer unit is designed to alleviate stress to the animals while they are kept inside the unit. DVR needs the additional cages to be manufactured by Lab Products so they are compatible to the existing units.� DVR was unable to find a similar unit made by other manufactures that has the same functionality and features.� Other sources would need to reverse engineer the cages to meet the specifications which can be time consuming and has the potential to escalate the costs.� Lab Products is the suggested source for this procurement as they 1) already possess the design for the cages which meet the specifications and 2) their pricing is considered fair and reasonable based on similar purchases in the past.� �� All responsible sources may submit a capability statement demonstrating the ability to provide the requested services, which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Interested vendors must respond to this notice on or before June 13 , 2023 at 1:00 pm Eastern Time by sending an email to holleyv@od.nih.gov .
