Description
The Department of Health and Human Services (HHS), National Institutes of Health (NIH), National Cancer Institute (NCI), Center for Cancer Research (CCR), Radiation Oncology Branch (ROB) plans to procure, on a sole source basis, additional ARIA software licenses, and software maintenance services for Varian ARIA, Eclipse, and InSightive Radiotherapy Treatment Planning Systems from: Varian Medical Systems 3290 Northside Parkway Atlanta, GA The response close date of the notice for this requirement is in accordance with FAR 5.203(b). This acquisition will be processed under FAR Part 12 � Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.501(a) and is exempt from the requirements of FAR Part 6. The North American Industry Classification System code is 811210 (Other Electronic Equipment Repair and Maintenance) and the business size standard is $34.0 Million. The ARIA-Eclipse-TrueBeam radiation system by Varian Medical Systems is a proprietary and highly complex FDA-approved medical treatment Regulatory Class II Medical Charged- Particle Radiation Therapy System. NCI�s ARIA-Eclipse-TrueBeam systems currently consist of multiple proprietary software�s including ARIA, Eclipse, InSightive, SmartConnect, as well as supporting hardware components produced and configured by the Original Equipment Manufacturer (OEM), Varian Medical Systems. To NCI�s knowledge, Varian Medical Systems does not currently have any third-party Independent Service Organizations (ISOs) who they provide with the most recent maintenance procedures, latest software patches/upgrades, or access to their SmartConnect application which automatically and remotely monitors and controls the functionality, and allows automatic remote diagnostic software, testing and calibration procedures critical for ensuring the systems are operating in accordance with its intended design. As such, no other vendor besides Varian Medical Systems can adequately address compatibility issues with software versions versus certain revisions of hardware or can upgrade the software as needed to�improve cybersecurity, reliability, and enhance the interface to prevent user errors. Having these abilities is essential for ensuring systems are operational, as well as ensuring patient safety. Further, Varian Medical Systems is the only known source for software licenses, as well as OEM parts necessary for performance of the stated requirements outlined in the Statement of Work (SOW), and as such is the only source from which ROB can obtain additional ARIA licenses required to accommodate additional ROB staff with needed software access. This notice is not a request for competitive quotations. However, if any interested party, especially a small business, believes it can meet the Government�s needs, it may submit a capability statement, proposal, or quote for the Government to consider. The response and any other information furnished must be in writing and must contain sufficient details to allow NCI to determine if the party can perform the requirement. Responses to this notice shall be submitted via email to Contract Specialist, John Russell, at John.Russell3@nih.gov by no later than 10:00 A.M. EST on Tuesday, June 20th, 2023 (06/20/23). A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a competitive procurement. The Government reserves the right to use the information provided by respondents for any purpose deemed necessary and legally appropriate. To receive an award, Contractors must be registered and have valid certification through SAM.GOV.
