- DESCRIPTION OF REQUIREMENT: This contract action is for the acquisition of supplies for which the Government intends to solicit and negotiate with only one source under the authority and procedures of Federal Acquisition Regulation (FAR) Subpart 13.106-1(b). The U.S. Environmental Protection Agency (EPA), Office of Acquisition Solutions (OAS) intends to award a single source purchase order to The Gordian Group, Inc., 30 Patewood Drive, Suite 350, Greenville, South Carolina 29615-6810, for the acquisition of RS Means Data License The anticipated period of performance is to be three (3) years after license activation. The associated North American Industrial Classification System (NAICS) code for this procurement is 511210�Software Publishers�. Its associated Small Business Size Standard is $41.5mil. The Office of Land and Emergency Management (OLEM) requires 100 Named EPA and State Users Annual Data License for EPA Cost Pro software. EPA for CostPro is EPA-developed software that provides EPA and state RCRA permit writers with a tool for evaluating cost estimates for closure and post-closure care of RCRA Treatment, Storage, and Disposal facilities (TSDFs). This item is for a data license for an EPA-developed software, Cost Pro by The Gordian Group, Inc. R.S. Means CostPro software allows the EPA�s Office of Resource Conservation and Recovery to provide enhanced cost estimation support to the hazardous waste program. The data will provide regulators accurate and up to date estimates of various facility closure and post closure care activity costs. This will assist regulators in reviewing financial assurance cost estimates that, when accurate, protect the taxpayers from footing the bill for closure and post closure care at more than one thousand hazardous waste facilities across the country. Acquiring these data will help to maintain a robust ability of EPA and state regulators to review and prepare closure and post closure cost estimates. Failure to obtain these RS Means data elements from Gordian would require EPA to make its own estimates of these costs, which would not be informed by the proprietary and extensive surveying and data collection performed by R.S. Means Company LLC. The quality of the data would almost certainly be lower and the cost to the government higher. The lower quality data could lead to poor cost estimates nationwide and a resulting inadequate amount of financial assurance. The Gordian Group, Inc., is the sole supplier and only source reasonably available to meet the Government�s needs. 100 Named EPA and State Users Annual Data License for EPA Cost Pro In addition, EPA will be allowed to activate up to 50 industry users working to support EPA RSMeans Building Construction Cost data and Site Work and Landscape Cost Data EPA will solicit and negotiate directly with The Gordian Group, Inc., and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations; however, if an interested party believes they can meet the above requirement, all responsible sources may submit a response which shall be considered by the agency. The information must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can meet the requirement. Offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government. All interested parties must express their interest in writing via email to Williams.Phillip@epa.gov within fifteen (15) days after the date of publication of this notice. No faxed documents will be accepted. If no responsive statements are received within fifteen (15) days, an award will be made to The Gordian Group, Inc.
