NOTICE OF INTENT to Sole Source SOLICITATION NUMBER: 75N95023Q00387 TITLE: �Replacement of turbo pump of liquid chromatograph-mass spectrometer CLASSIFICATION CODE: J066 � Maintenance/Repair/Rebuild of Equipment � Instruments and Laboratory Equipment NAICS CODE: 811210 � Electronic and Precision Equipment Repair and Maintenance RESPONSE DATE: June 21, 2023, at 12:00 PM ET PRIMARY POINT OF CONTACT: Maggie Brant Maggie.brant@nih.gov Phone: 301.827.1771 DESCRIPTION: INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute of Mental Health (NIMH) intends to negotiate on a sole source basis with Thermo Electron North America LLC for repair services. The requested service is for the PET Radiopharmaceutical Section within Molecular Imaging Branch (MIB) of the NIMH. The MIB�s laboratory is equipped with ThermoFisher Scientific�s liquid chromatograph-mass spectrometer (LC-MS; model: Velos Pro; serial no. EXR-LTQ-30153).� The LC-MS is used for analyzing positron-emission tomography (PET) radiotracers and other compounds synthesized in the laboratory.� This analytical instrument provides mass spectral data needed for a definitive characterization of radiotracer prior to its injection into human subjects for PET imaging. Presently, Velos Pro LC-MS� is not operational because of failure of its vacuum system. The instrument�s turbo pump is not spinning and thus not generating the vacuum.� The purpose of the project is to have the broken turbo pump replaced by a qualified engineer from Thermo Electron North America LLC (subsidiary of ThermoFisher Scientific). NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 811210 � Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $34 million. � REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2023-04 dated June 2, 2023. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The purpose of this requirement is to procure repair services from Thermo Electron by the NIMH. A qualified engineer shall replace the turbo pump of the Velos Pro LC-MS that involves: (i) checking the vacuum status and then powering down the MS unit; (ii) open the housing and dismount the turbo pump and the controller from the mass analyzer; (iii) install the new pump and controller; (v) put housing back and then power up the MS; (vi) check if the new turbo pump is spinning and monitor the vacuum in the MS manifold; (v) after 12 hours, confirm that the ion gauge reports the desired vacuum; (vi) perform calibration and tuning of the MS.� After completion of the task, the contractor shall prepare a report and submit it to the laboratory supervisor. The assigned engineer should have the requisite training plus experience to install the turbo pump on the Velos Pro LC-MS system. The estimated time for this repair is approximately 16 hours.� The contractor shall submit a written report (electronic-copy by e-mail; or a hard-copy to the address below) within three days after installation new turbo pump on Velos Pro LC-MS.�� One original copy shall be signed by the contractor�s engineer. The progress report shall cover all work completed during the specified period and shall present the work to be accomplished during the subsequent period. This report shall also identify any problems that arose and a statement explaining how the problem was resolved. Additionally, this report shall identify any problems that have arisen but have not been completely resolved and provide an explanation. ESTIMATED PERIOD OF PERFORMANCE: The contractor shall send engineer to the site within two weeks of receipt of the award.� Upon arrival, the engineer shall install the new turbo pump within two days. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, Thermo Electron North America, LLC is the only vendor in the marketplace that can provide the services required by NIMH. The turbo pump and an auxiliar part as well as engineer (or technician) must come from the instrument�s manufacturer in order to get compatible parts and not void the warranty. Only this suggested source can furnish the requirements, to the exclusion of other sources, because ThermoFisher Scientific (parent company of Thermo Electron) is the manufacturer of the Velos Pro LC-MS. The intended source is: Thermo Electron North America, LLC 1400 Northpoint Pkwy Ste. 10 West Palm Beach, FL� 33407-1976 CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Unique Entity ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by the closing date and time of this announcement and must reference the solicitation number, 75N95023Q00387.
