- OF INTENT TO SOLE SOURCE. This is not a request for competitive proposals/quotes. The Centers for Disease Control and Prevention (CDC), National Institute for Occupational Safety and Health (NIOSH), hereby announces its intent to issue a sole source order/contract to Rigaku Americas Corporation. The NAICS code for this acquisition is 541519, Other Computer Related Services, with a size standard of $34.0 million. The Health Hazards Prevention Branch (HHPB), part of the NIOSH Pittsburgh Mining Research Division (PMRD), requests to purchase software, SmartLab Studio II. This software package operates the X-ray diffractometer (XRD), an analytical laboratory instrument. This instrument is used for measuring the identity and amount minerals in mine dust as part of research on preventing miners� exposure to respirable mineral hazards. The only software that is compatible with the XRD instrument is software that is proprietary to Rigaku. The current software which operates the instrument is out-of-date and is nearing its planned obsolescence. The SmartLab Studio II software is the proprietary software intended to replace the obsolete software. The vendor must be able to install the SmartLab Studio II software package to the desktop computer for the XRD after the purchase of the software is complete. The software package will include the following: SmartLab Studio II Software � Ten (10) User Network License, part number 1021831. SmartLab Studio II Powder Basic Analysis Plugin, part number 1020506. SmartLab Studio II Powder Comprehensive Analysis Plugin, part number 1020507. SmartLab Studio II Powder Rietveld/WPPF Analysis Plugin, part number 1020509. Computer Set up, part number 903773IT. Onsite installation and integration by Rigaku Service Engineer A determination by the Government not to compete this proposed action will be based on responses to this notice and is solely in the discretion of the Contracting Officer. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. All vendors must be registered in the System for Award Management (SAM) at www.sam.gov. This action is for services which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b) and 10 U.S.C. 2304(c)(1). Interested persons may identify their interest and capability to respond to the requirement or submit quotations. This is not a request for competitive quotations; however, the Government will review any/all product, capabilities, and pricing information submitted prior to the closure of this notice. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
